الملخص
يدرس هذا البحث مسألة فقهية أصولية في غاية الأهمية؛ وهي إمكانية تعدد الأحكام في المسألة الواحدة، وعدم انحصار مذهب السلف ومنهجهم في قول واحد دائما، ويهدف البحث إلى بيان أهمية ارتباط الخلف بالسلف فقها واستنباطا وفهما واستدلالا، والرد على مغالطة من يقول بأن منهج السلف في الفقه واحد، كما يهدف إلى بيان وتعليل إمكانية تعدّد المذاهب والأحكام الفقهية في المسألة الواحدة، والتشجيع على قبول الأمر وعدم المبالغة في رفض وإقصاء المخالف؛ وذلك بإيراد وتحليل جملة من المسائل التي اختلف الصحابة رضي الله عنهم في حكمها، ومن أهم نتائج البحث أنّ قول القائل: "أنا على منهج السلف" لا يُمكن قبوله على إطلاقه، حيث أنه بهذا نفى الصواب عن غيره؛ كأنّ السلف أجمعوا في كل المسائل الفقهية، والثابت أنّهم اختلفت فهومهم لكثير من النصوص فاختلفت أحكامهم في مسائلها، كما ثبت اختلافهم في كثير من الاجتهادات عند عدم وجود النص، فليس كل مخالف مُخطئ، فقد يكون المختلفان حُكما كلاهما مُصيب وكلاهما على منهج السلف. This research studies a very important issue in Fiqh and Usul. It is the possibility of multiple rulings in the same issue. Because the doctrine of "Salaf" and their methodology not always be confined in one saying. The research aims to demonstrate the importance of the successor’s association with the predecessors in jurisprudence, deduction, understanding and inference. In addition to the response to the fallacy of those who say that, the methodology of the "Salaf" in jurisprudence is one. It also aims to explain and justify the possibility of multiple jurisprudential schools and rulings on the same issue. With encouragement to accept the matter, and not to exaggeration in reject and exclude the dissenting. By mentioning and analyzing some issues that the Companions, May God be pleased with them, differed in its ruling. Among the most important results of the research is that the saying: “I follow the methodology of the predecessors” not accepted in all cases. Because if he said this saying, he denies the correctness of others. It known that the predecessors were not unanimous on all Fiqh issues. They differed in their understanding of many texts, so their rulings differed in its issues. They also differed in many jurisprudences when the text was not available. In addition, not every opponent is wrong. Because the two who differ in ruling may both are be correct, and both are according to the methodology of the predecessors
