أهمية التعجيل بمواءمة المواثيق الدولية في تقنين الظواهر الإجرامية -جرائم التمييز العنصريّ وخطاب الكراهية أنموذجا-

الملخص
يدرس هذا البحث أهمية التواصل التشريعي بين القوانين المحلية واللوائح الدولية، ويهدف إلى تحديد العلاقة بين الاتفاقيات والعهود الدولية، والتشريعات والقوانين المحلية، والإشارة إلى أهمية مواءمة التطورات التشريعية على الصعيد الدولي، كما يهدف إلى بيان النتائج الإيجابية للمواءمة التشريعية في ضبط الظواهر الإجرامية؛ وذلك من خلال تقييم الإطار الزمني للقانون رقم 20-05 المتعلق بالوقاية من التمييز وخطاب الكراهية، ومن أهم نتائج البحث أنّ المواءمة التشريعية للقوانين الدولية مطلب مهم في التقنين ولها آثار حسنة؛ حيث يتحقق التواصل التشريعي بين القوانين ويزداد ذلك التشريع دقة وتقدما على الصعيد الدولي، كما أنه على المشرّعين التعجيل بتقنين كل ظاهرة اجتماعية سلبية تنص عليها المواثيق الدولية، فتكون تلك المواكبة والمواءمة علاجًا إذا انتشرت الظاهرة، أو تكون حاجزًا وقائيا منها. This research studies the importance of legislative relevance between internal laws and international regulations. It aims to define the relationship between international conventions and covenants, and internal legislation and laws, and to indicate the importance of harmonization with legislative developments at the international level. It also aims to show the positive consequences of legislative harmonization in controlling criminal phenomena, through evaluating the time issuance of Law No 20-05, relating to the prevention of discrimination and hate speech. Among the most important results of the research is that the legislative harmonization of international laws is an important purpose in legalization, and it has positive effects. This achieves legislative communication between laws, and increases the accuracy and progress of the legislation at the international level. In addition, legislators must expedite the legalization of every negative social phenomenon stipulated in international covenants. Moreover, the keeping pace and harmonization represents a remedy for this phenomenon if it spread, or forms a protective barrier against it
