"مجلة الشريعة والاقتصاد" هي مجلة دولية متاحة للـمتصفحين على الأنترنيت، وتصدر بصورة منتظمة مرتين في السنة عن كلية الشريعة والاقتصاد بجامعة الأمير عبد القادر للعلوم الإسلامية - قسنطينة، الجزائر، وقد تمّ إصدار أول أعدادها في سنة 2012 م، وتعنى بنشر الأعمال العلمية في الدراسات الشرعية والقانونية والاقتصادية.

توفر الـمجلة منصة أكاديمية متخصصة، تنشر من خلالها مقالات أصلية ومحكمة، وتلبي حاجة الباحثين من داخل الوطن وخارجه. ويتسم البحث المنشور فيها بالموضوعية والجدية والأصالة والحداثة، والنشر فيها متاح لكل باحث باللغات الثلاث: العربية، والإنجليزية، والفرنسية، على أن يكون المقال مستوفياً لقواعد النشر الخاصة بالمجلة، وتخضع جميع الأعمال العلمية المقدمة للنشر للتحكيم من قبل هيئة علمية دولية متخصصة.

 

Charia and Economics review is an international open access journal, bi-annual and free of charge, published by the Faculty of Charia and Economics, Emir Abd El Kader University of Islamic Sciences-Constantine – Algeria, first published in 2012. The journal focuses on the following topics: specialized legitimate, legal and economic studies. It provides a specialized academic platform through which it publishes original and refereed articles and meets the need of researchers from inside and outside the country. The research published in it is characterized by objectivity, seriousness, originality, and modernity Publication in it shall be available to every researcher in Arabic, English and French, provided that the article meets the publishing rules of the journal All papers submitted for publication are subject to arbitration by a specialized international scientific body

التَّحقيقُ في مسألة تعجيل الزَّكاة قبل الحَوْلِ عرض منهجي مُقارن

الملخص: مسألة:" تعجيل الزَّكاة قبل الحولِ " من المسائل الفِقهيَّة التي اختلفَ فيها العُلماءُ الأعلام، وتضاربت حَوْلَ حُكمِها الأدلَّةُ منذ قديمِ الأيَّام وغابر الأعوام، ولكن اشْتَدَّ فيها النِّقاشُ واحْتَدَّ حولها الكلامُ في هذا الزَّمان، خاصَّة وأنَّها تَتَعَلَّقُ بأحد الأركان التي بُنِيَ عليها الإسلام. فتأتي هذه الوَرَقةُ البحثيَّةُ لدراسة المسألة في رحابِ الفقه الإسلاميّ المقارن، القائم على سَرْدِ مذاهب الفُقهاء وحِكاية أقوالهم، وبيان ما عَوَّلُوا عليه من الأدلَّة فيما ذهبُوا إليه، مع تجليَّة المدافعات التي دارت بينهم، للخُلوصِ إلى القول الرَّجيحِ، بحسَبِ ما يوصل إليه النّصُّ الشَّرعيُّ الصَّحيح، ويمليه المقصد المرعيُّ المليح. وتَتَنَزَّلُ هذه الدِّراسة المقارنة ضِمن الدَّعوة الجادَّة إلى ضرورة تقدير المذاهب الفِقهيَّة حقّ قدرها، والعمل على خِدمتها وتبجيل أمرها، مع التَّأكيد على حَتْمِيَّة التَّخفيفِ من التَّعصُّبِ المذمُومِ لاجتهاداتِ الأشخاصِ وترجيحاتهم، كما تَتَغَيَّا هذه الورقات كيفيَّة صِناعة العقل الفِقهيّ المعاصر، والدُّربة والمِران على تكوين المَلَكَة الفِقهيَّة المُتضلِّعة التي لا تَتَحَقَّقُ إلَّا من خِلال استشرافِ أقوال الأئمَّةِ الرَّبانيِّين، وقادة الأمَّة الرُّوحانيِّين. The issue: “Accelerating zakat before the year” is one of the jurisprudential issues in which eminent scholars have disagreed, and the evidence has conflicted over its ruling since ancient times and past years, but the debate has intensified and the talk around it has become heated in this era, especially since it relates to one of the pillars on which Islam was built. This research paper aims to study the issue within the scope of comparative Islamic jurisprudence, which is based on narrating the doctrines of the jurists and the story of their sayings, and explaining the evidence they relied on in what they argued, while clarifying the defenses that took place between them, in order to arrive at the most correct opinion, according to what the correct legal text arrives at. The destination is dictated by the pleasant pasture. This comparative study falls within the serious call for the necessity of appreciating the schools of jurisprudence properly, and working to serve them and venerate them, while emphasizing the inevitability of reducing the reprehensible intolerance of people’s opinions and preferences. These papers also change how to create the contemporary jurisprudential mind and training And training on the formation of a well-versed jurisprudential faculty Which can only be achieved by looking at the sayings of the divine imams and the spiritual leaders of the nation.
