Description

An international, bi-annual, free and peer-reviewed journal published by El Bassira Center for Research, Consulting and Learning Services, Algeria. The journal focuses on publishing research and articles in the field of Islamic sciences, it receives scientific research in the three languages: Arabic, English and French. It aims to: - Publish and encourage the production of researchers and scholars, including professors, researchers and doctoral students, especially research related to the cultural and social environment, regarding to Islamic sciences. – Promote scientific research in Islamic studies and Islamic heritage in general – Encourage intellectual studies, as well as studies in the field of comparative religion to achieve human dialogue and introduce Islam – Encourage jurisprudence, Quranic and hadith studies to serve intellectual issues, especially emerging ones – Encourage research in the fields of social and human sciences. The journal is committed to publish original research that fulfills the required academic conditions, and rejects what violates the ethics of scientific research and scientific integrity.

التربية الجمالية في الإسلام وإمكانية تفعيلها في الوسط التربوي

الملخص: تعالج الدراسة أبعاد توظيف التربية الجمالية الإسلامية في الوسط التربوي بما تحمله من قيم الإبداع والتطوير، كما تسلط الضوء على ارتباط الإسلام بالمجال العاطفي، وسعيه إلى تنمية الذوق الجمالي كشرط أساسي في تقويم السلوك الاجتماعي العام. وقد هدفت الدراسة إلى وضع بعض الأساسات لرؤية تربوية جديدة تعنى بتفعيل القيم وتجمع بين الحس الديني والمضمون الإجرائي والرؤية الفلسفية. واعتمدت في ذلك على المنهج التحليلي الذي نحاول فيه أن نقف على مضمون النظرية الجمالية في الإسلام، والمنهج المقارن من خلال عرض الأفكار المتقابلة بين النظرة الدينية التأصيلية ومجال علم النفس التربوي. وخلصت الدراسة إلى ضرورة الاستفادة من التراث الإسلامي بما يمثله من مادة هائلة في الرؤية والتوجيه للعواطف. كما انتهت إلى أن علاقة التربية الجمالية بالمقررات الدراسية هي علاقة شرطية نظرا للتداخل البيداغوجي بين المضمون النفسي والبنيات التعليمية الأساسية، ولا يتصور أي مخرجات تعليمة مبتورة من أي تشكيل عاطفي متوازن. The study deals with the dimensions of employing Islamic aesthetic education in the educational environment, with its values of creativity and development. It also focuses on the connection of Islam with the emotional field, and its quest to develop aesthetic taste as a prerequisite in evaluating general social behavior. The study aimed to lay down some rules for a new educational vision that takes care of activating values and combines religious sense, procedural content and philosophical vision. The study relied on the analytical approach in which we try to stand on the content of the aesthetic theory in Islam, and the comparative approach by presenting the opposite ideas between the fundamental religious view and the field of educational psychology. The study concluded that it is necessary to benefit from the Islamic heritage, as it represents an enormous material in vision and guidance for emotions.

الملخص: ملخص: تتغيا هذه الدراسة الإبانة عن علم من أعلام المغرب وفقيها من فقهاء العصر العلوي، له مشاركات في الفقه والأصول والتفسير والمنطق والبيان، أبدع وأجاد في النحو ومهر فيه، وله في ذلك شروح وتقاييد، ارتبط اسمه أشد ارتباط بكتابه الموسوم "بلوغ أقصى المرام في شرف العلم وما يتعلق به من الأحكام" لامس من خلاله واقع العلم في زمانه وما آلت إليه الحركة العلمية بنفس إصلاحي، ومنهج نقدي فريد. أما الغاية الثانية من هذه الدراسة فهي الكشف والإسفار عن مناهج العلماء المغاربة في تدريس النحو أو ما يسمى بلغة العصر "الديداكتيك"، من خلال دراسة وتخريج أحد أعمال الفقيه الطرنباطي، ووضعها بين يدي الباحثين، وتقريبها إلى الطلبة والمهتمين، وإحيائها وإخراجها من رفوف النسيان. Abstract: This study aims to introduce one of the Moroccan Scientists, who has contributions in jurisprudence, principles, interpretation, logic and eloquence. His name was associated with his book, "Achieving the Ultimate Goal in the Honor of Science and the Rulings Related to It", through which he explained the reality of science in his time and the outcome of the scientific movement with a unique critical approach. As for the second objective of this study, it is to reveal the methods of Moroccan scholars in teaching grammar, or what is now called “Didactic”, by studying one of the works of the jurist al-Tarnbati, and placing it in the hands of researchers, students and those interested, and reviving it and bringing it out of oblivion.

نحو صياغة نظرية للعقد السياسي مقاربة فقهية Towards formulating a theory of the political contract A Jurisprudential Approach

الملخص: هذا البحث قراءة فاحصة تستكشف التراث الفقهي السياسي، وتعيد ترتيب أجزاء من مادته العلمية بهدف الوصول إلى استخلاص عناصر نظرية العقد السياسي، وبيان دلالاتها التعاقدية. والعناصر التي تم معالجتها من شأنها تأكيد إمكانية صياغة مثل هذه النظرية، وهي: ماهية العقد، وأساسه الشرعي، وأهلية المتعاقدين، وأركان العقد وما يتفرع عنه من تحديد طرفي العقد، ومحل العقد أو المعقود عليه، وصيغة العقد، والإرادة وأثرها على إنشاء العقد، وانحلال العقد وضوابطه، والإكراه وآثاره القانونية. ومع أن هذه العناوين لم ترد في التراث السياسي الفقهي مبوبة ومرتبة بهذا الشكل، إلا أن المادة العلمية الدالة عليها حاضرة بقوة، وجاءت متفرقة في مباحث وثنايا المطولات الفقهية وكتب السياسة الشرعية This research is an inspecting reading that explores the political jurisprudential heritage, and reorders the elements of its literary. The aim of this reading is extracting the elements of the political contract theory, and clarifying its contractual signification. In this context, this paper will deal with the following elements: the concept of the contract, its legal basis, the eligibility of the contracting parties, the contract pillars, the subject of the contract, the form of the contract, the impact of the contract, the abrogate of the contract. Although these titles did not appear in the political and jurisprudential heritage classified and arranged in this way, they are present in its literary, but dispersed through chapters of jurisprudential books and encyclopedias.
