عقد الاعتماد الإيجاري للأصول غير المنقولة كآلية للتمويل

الملخص
ععقد الاعتماد الإيجاري آلية حديثة للتمويل، ظهرت نتيجة عدم قدرة الوسائل التمويلية التقليدية على ذلك، حيث يرتكز هذا العقد على قيام مؤسسة التمويل بشراء كل ما يحتاج إليه المشروع من معدات أو تجهيزات أو عقارات، وتحتفظ بملكيتها وتؤجرها إلى المستأجر نظير بدل إيجار يمثل مقابل استهلاك كل الأموال المؤجرة ومقابل النفقات الحالية والفائدة المقررة على المبلغ المدفوع في شراء تلك الأموال. حيث تظل مؤسسة التمويل مالكة للأموال المؤجرة خلال مدة الإيجار وبإمكانها استردادها بوصفها مالكة لها عندما يتوقف المستأجر أو يمتنع عن دفع بدل الإيجار، أو عند إخلاله بشروط عقد الإيجار. وتسترد تلك الأموال من تفليسة المستأجر دون أن تتعرض لإجراءات الإفلاس ولخطر عدم استيفائها كلية أو جزء منها. وعند انتهاء مدة الإيجار يمنح للمستأجر حق الخيار بين شراء هذه الأموال موضوع عقد الاعتماد الإيجاري بثمن متفق عليه مسبقا، أو تجديد العقد بشروط جديدة تتناسب مع حالة الأموال المؤجرة أو انتهاء عقد الإيجار، وإعادة الأموال إلى مؤجرها. The rental lease agreement is a modern funding mechanism that emerged as a result of the inability of traditional financing means to do so. This contract is based on the financing institution purchasing all the equipment, material, or real estate the project needs while it maintains its ownership. It leases it to the lessee in exchange for a rental fee representing an exchange for the use of all the leased, against current expenditures, and assessed interest on the amount paid in the purchase of those possessions. Where the financing institution remains the owner of the leased possessions during the lease term and can recover it as being its owner when the tenant stops or refuses to pay the rent allowance, or if he breaches the terms of the lease contract. These funds shall be recovered from the lessee's bankruptcy without being subjected to bankruptcy procedures and without the risk of not fully or partially fulfilling them. Upon the expiry of the lease period, the lessee is granted the right to choose between purchasing these materials, subject of the rental approval contract, at a pre-agreed price, or renewing the contract with new conditions commensurate with the status of the leased materials or the termination of the lease contract, and returning the funds to the lessor.
