قراءة في الأحكام الخاصة للمسؤولية عن الحريق على ضوء القانون 19-02 المتعلق بالقواعد العامة للوقاية من أخطار الحريق والفزع

الملخص
لطالما اقتص رت الحماية القانونية للأشخاص والممتلكات والبيئة ضد مخاطر الحريق على الحق في التعويض الذي يحصل عليه المضروربناءا على أحكام المسؤولية المدنية التقصيرية وعقوبات جزائية يتم تقريرها بموجب قانون العقوبات،لذا تسعى الدراسة لبيان الأحكام المستجدة التي حملها القانون 19-02 في طياته المتمثلة أساسا في مراجعة وتركيز شروط تحقق المسؤولية عن الحريق فضلا عن إقراره لجملة من التدابير الوقائية واستحداثه للجان رقابية للوقاية من مخاطر الحريق والفزع مع تعزيزها بعقوبات جزائية مقررة في حق المسؤول عن حدوث الأضرار المترتبة عن الحريق. الكلمات المفتاحية: مسؤولية مدنية،الحريق والفزع،مخاطر الحريق The legal protection of persons, property and the environment against fire hazards has always been limited to the right to compensation, based on the provisions of civil liability and penal sanctions, which are determined by the Penal Code. Therefore ,the study seeks to clrify the new provisions of Law 19-02 in its review. Focusing on the conditions of verification of fire responsibility, as well as the adoption of a set of preventive measures and the establishment of oversight committees to prevent the risks of fire and panic, while reinforcing punitive penalties against those responsible for the damage caused by the fire Keyword : Civil Liability, Fire and Dread, Fire Hazards. Résumé La protection juridique des personnes, des biens et de l’environnement contre les risques d’incendie a toujours été limitée au droit à réparation des victimes en vertu des dispositions de la responsabilité délictuelle et pénale qui doivent être déterminées par le Code pénal. Mettre l'accent sur les conditions de vérification de la responsabilité des incendies, ainsi que sur l'adoption d'un ensemble de mesures préventives et la mise en place de comités de surveillance pour prévenir les risques d'incendie et de panique, tout en renforçant les sanctions punitives contre les responsables des dommages causés par l'incendie.
