Description

The Social and Human Sciences Review is an international Refereed scientific bi-annual and free of charge, open-access journal published by Larbi Tebessi University, Tebessa, Algeria. It was founded in 2005 and is interested in the dissemination of original applied research, which has not been previously published and which is treated in a documented scientific method in the field of policy and law sciences, international relations, and public administration. The review publishes original research and scientific studies in the fields of social and human sciences in all its branches. It provides an academic platform for doctoral students, university teachers and all Researchers, whether in research circles, academic or government departments or economic institutions at the national and international levels. The review contributes to the dissemination of innovative works in various fields and this by providing authentic research that is presented accurately and objectively in a scientific manner that conforms to the specifications of the articles. The journal opens a space for those with scientific abilities to contribute to the new topics related to the field of specialization to be published every semester (June - December). All the newspapers around the world are very welcome in the international journal. The review accepts, for submission, articles written in Arabic, English and French. الملخص: تعتبر المساواة بين النساء والرجال حقا من حقوق الانسان التي عملت على تأكيدها مختلف المواثيق الدولية العالمية منها أو الإقليمية، إلا أنه وعلى الرغم من ذلك مازالت تعتريه العديد من المعوقات التي تحول دون تجسيده على أرض الواقع لا سيما بالنسبة لدول العالم الثالث حتى وفي ظل مصادقة الدول على الاتفاقيات الدولية التي تكرس هاته الحقوق، إذ تبقى حقوق المرأة حقوقا منقوصة وغير مجسدة على أرض الواقع سواء تعلقت هاته الحقوق بالمجال السياسي أو بالمجال الاقتصادي. وتأتي دراستنا هاته من أجل بيان دور المؤسس الدستوري الجزائري في حماية حق المرأة في العمل ودراسة التجسيد العملي لهذا التكريس على أرض الواقع وفيما إذا كان له دور في تمكين المرأة اقتصاديا أم لا؟ Equality between women and men is a human right that many of the regional and international conventions have worked to affirm. However, many obstacles prevent its embodiment, especially in developing countries where, in spite of having ratifying the international agreements regarding the embodiment of these rights, women’s rights, political as well as the economic ones, remain incomplete and absent in practice Our intervention comes to explain the role of the Algerian constitutional founder in protecting the right of women to work and to study the practical embodiment of this dedication on the ground and whether it has a role in empowering women economically or not?

فاعلية برنامج المرشد المنهجي بالمراكز النفسية البيداغوجية للأطفال المعوقين ذهنيا

الملخص: تهدف دراستنا للتعرف على البرنامج المرشد المنهجي للمراكز النفسية البيداغوجية للمعوقين ذهنيا في ولاية عنابة، وعرض العناصر المتوفرة فيه، واكتشاف إذا كان محتوى المرشد يحترم شروط بناء البرامج لذوي الإعاقة الذهنية فللبرامج التربوية مكانة ودور أساسي في المراكز البيداغوجية على الصعيد التكافلي والتأهيلي، فلابد التوفر بها مجموعة من الشروط والأساسيات لتحقيق الغرض الذي وجدت من اجله. وعليه لتحقيق اهداف دراستنا اعتمدنا على المنهج الوصفي في البحث، ولتقصي عن المعلومات اعددنا شبكة تحليل محتوى وتم تطبيقها على البرنامج المرشد، وعن طريق العينة القصدية أجرينا مقابلة مع الاخصائيين في المراكز البيداغوجية ، وتوصلت نتائج الدراسة الى اثبات الفرضية الرئيسية على: ان محتوى البرنامج المرشد المنهجي فعالية إيجابية في مراكز النفسية البيداغوجية للمعاقين ذهنيا، من حيث التسيير واستوفاء شروط وأسس بناء البرامج، الا به ثغرات لابد تداركها، كعدم التطرق لتصنيفات المعاقين ذهنيا وعدم تخصيص برنامج، او تصميم بطاقات فنية حسب درجة الإعاقة، كما انه غير محدثة Our study aims to research the methodological guide program of the Pedagogical Psychiatric Centers for the Mentally Handicapped in Annaba Province, to explore whether the content of the program respects the requirements of building curricula for mental disabilities, Therefore, we relied on the descriptive approach in research. We prepared a content analysis network and it was applied to the program, and with the intentional sample, we interviewed specialists in pedagogical centers. The results proved the main premise that the content of the methodological guidance program is a positive effect on the pedagogical centers. However, it has gaps that must be addressed, such as not addressing the classifications of the mentally handicapped, not allocating a program or designing artistic cards according to the degree of disability, and not being developed

الملخص: تشكّل الأنثى أهمّ حلقات النّص الرّوائي العربي المعاصر، حيث أعطت للرّواية طعما آخر حين وُظّفت بطريقة جريئة تخترق المألوف من خلال توظيفها بمختلف مفهوماتها وتناقضاتها، فتعدّ الأنثى الشّخصية الأكثر تعقيدا من حيث تجسيدها لهمومها وفهم صراعاتها الدّاخلية، وقد تجرّأ عزّ الدّين جلاوجي ليظهر الأنثى في رواية "الرّماد الذي غسل الماء" بطريقة أخرى بعيدا عن مفهوم الطّاعة والالتزام، حيث اعتمد مرجعيات تحيلنا على مختلف السياقات المضمرة لخطاب التمرّد لدى الأنثى، من أجل إثبات هويّتها الشخصية واستقلاليتّها، فمدينة الرّماد مثّلت نموذجا لتناقضات بين منظور الفضاء النّسائي المتمرّد والرّجالي الخاضع، والّتي تتّكئ على مرجع واقعي وعجائبي، والهدف من دراستنا استجلاء العناصر الآتية: دراسة الأنثى كشخصية مرجعية محيلة على التمرّد في فضاء مدينة عين الرّماد، وكيف اعتمد جلاوجي التمرّد كوسيلة للدّفاع عن الأنثى بطريقة مضمرة لاتوازنية. The female constitutes the most important episodes of contemporary Arab novelist text, as she gave the novel another flavor when it was employed in a bold way that penetrates the familiar by employing its various concepts and contradictions. "Ashes that washed the water" in another way, away from the concept of obedience and commitment, as it relied on references that refer us to the various implicit contexts of the discourse of rebellion among the female, in order to prove her personal identity. On a realistic and fictional reference, and we will try, through our study, to elucidate the following elements: the study of the female as a reference figure referring to the rebellion in the space of the city of Ain al-Ramad, and how Djelaouji adopted the rebellion as a means of defending the female in an implicit and unbalanced way. الملخص: تتنوّع الظواهر الإيقاعيّة في الشّعر العربي قديما وحديثا، وتختلف تأثيراتها الموسيقيّة والدلالية، والتدوير أحد هذه الظواهر التي عرفت منذ القديم؛ إذ يعد أداة شعرية قد يستخدمها الشاعر في نظم قصائده، ونظرا لهذه المكانة التي يحظى بها، جاءت هذه الدراسة لتكشف ظاهرة التدوير وأثرها الإيقاعي في الشعر العباسي متخذين قصائد أبي الفتح البستي أنموذجا للتحليل والمقاربة. ونروم من دراستنا الوقوف على أثر التدوير في توليد الدلالات في ديوان أبي الفتح البستي، ودوره الإيقاعي باعتباره أحد الوسائل التي تمتلكها اللغة للتّعبير عن المعاني وظلالها من جهة، والجمال الإيقاعي من جهة أخرى، الذي يثير الملتقي ويربطه بالنص فيتفاعل معه ويتواصل مع معانيه. Abstract: Rhythmic phenomena in Arabic poetry, ancient and modern, vary, and their musical and semantic influences vary, and rotation is one of these phenomena that has been known since ancient times. It is considered a poetic tool that the poet may use in the composition of his poems, and given this position he enjoys, this study came to reveal the phenomenon of rotation and its rhythmic effect on Abbasid poetry, taking the poems of Abu Al-Fath Al-Basti as a model for analysis and approach. We aim from our study to examine the effect of rotation in generating semantics in the Diwan of Abu Al-Fath Al-Basti, and its rhythmic role as one of the means that language possesses to express meanings and their shadows on the one hand, and rhythmic beauty on the other hand, which provokes the meeting and links it to the text, interacting with it.

توجهات القضاء الفاصل في المادة الإدارية في نطاق المسؤولية دون خطأ

الملخص: تطرح هذه الورقة البحثية إشكالية بالغة الأهمية تتمحور حول مدى وجود سياسة قضائية حكيمة في نطاق هذا الموضوع، بغية تكريس عدالة إدارية بما يتوافق وحماية الحقوق، بآليات منسجمة ومتواترة من خلال تبيان الصعوبات التي تعترضه، وأهم السمات التي تغلب على طبيعة عمله القضائي، وذلك بتتبع مجموعة من قراراته القضائية بالتحليل والتعليق بما يبرز أهم المعالم الرئيسية لهذا الموضوع، وتم التوصل إلى الجزم بعدم وجود أي سياسة قضائية واضحة للقضاء الفاصل في المادة الإدارية، بما يستدعي ضرورة إعادة النظر وتكثيف الجهود القضائية والتشريعية والأكاديمية والتعاون فيما بينها لوضع رؤية جزائرية قانونية خالصة؛ تمكن من بناء معالم واضحة لسياسة قضائية رشيدة في ظل التصورات الدستورية الجديدة. This paper examines the extent to which there exists wise judicial politics in Algeria in relation to administrative responsibility without a fault, which aim at establishing administrative justice in a way that protects rights through consistent and frequent mechanisms. The study clarifies the struggles that this judiciary encounters and the most important characteristics of its work. It tracks a selection of its judicial decisions by analysing and commenting on them to highlight the main features relevant to this subject. This paper concludes that there is no clear judicial policy in this regard which, therefore, necessitates serious reconsiderations to increase judicial, legislative, and academic efforts and their cooperation in a way that meets a purely Algerian legal vision that enables the building of clear landmarks for a rational judicial policy in light of the new constitutional perception.

L’identification du référent dans les chaines de référence

Résumé: Une anaphore, traditionnellement, sert à reprendre un élément du même contexte appelé son antécédent. Ce phénomène textuel par excellence a été soumis à de multiples travaux qui s’interrogeaient sur sa fonction réelle. Les différentes études qui lui ont été consacrées ont permis de distinguer que ce phénomène dépasse de loin une simple reprise. L’anaphore nominale en utilisant différents lexèmes ne reprend pas seulement l’antécédent mais permet aussi d’en ajouter des informations inédites (anaphore infidèle). L’éloignement des éléments les uns des autres formant une chaine (chaine de référence), complique, de son côté, la possibilité du maintien du rapport attendu. La résolution anaphorique, du fait, nécessite l’intégration d’un savoir cotextuel et contextuel sollicitant la mémoire discursive activée par l’«inférence ».
