الملخص
يعتبر الوصول إلى دولة الحق والقانون نتيجة لتجسيد الحكم الديمقراطي الحقيقي وترسيخه، فهي من أبرز العناصر المكونة له، لذلك تسعى الدول في وقتنا الحالي إلى بلوغ دولة الحق والقانون، وصولا للحكم الرشيد، وعليه نسعى في هذا البحث إلى دراسة مسألة التأسيس لدولة الحق والقانون من خلال تطبيق مبادئ الحكم الرشيد، من خلال تبيان المقومات التي يجب أن تتوفر لقيام دولة الحق والقانون، وتوضيح مؤشرات الحكم الرشيد، والضمانات اللازمة لقيام دولة الحق والقانون، وذلك من خلال طرح الإشكالية التالي: كيف يتم التأسيس لدولة الحق والقانون من خلال تطبيق مبادئ الحكم الرشيد؟ وللإجابة عن ذلك سنحاول التركيز على المحاور التالية: 1. مفاهيم ومضامين كل من: دولة الحق والقانون، الحكم الرشيد. 2. مقومات دولة الحق والقانون، ومبادئ ومؤشرات الحكم الرشيد. 3. الضمانات اللازمة لقيام دولة القانون بتكريس مبادئ الحكم الرشيد ومقومات دولة الحق والقانون. Access to the state of law and justice as a result of the embodiment of the real democratic rule and consolidation, it is one of the most important elements of it, so that the countries are currently seeking to reach the rule of law and the rule of good governance, and therefore we seek in this research to study the establishment of the rule of law through Implementing the principles of good governance, by clarifying the elements that must exist for the establishment of the state of law and the law, and clarifying the indicators of good governance and the guarantees necessary for the establishment of the state of law and law, by raising the following problem: How is the establishment of the state of law and law through the application of the principles of good governance? To answer this, we will try to focus on the following topics: 1. Concepts and contents of: the state of truth and law, good governance. 2. The foundations of the rule of law and the principles and indicators of good governance. 3. Safeguards for the establishment of the rule of law by enshrining the principles of good governance and the principles of the rule of law and law.
