قراءة تحليلية للمرسوم التنفيذي 320/16 المتعلق بمنصب الأمين العام للبلدية

الملخص
تناولت هذه الورقة البحثية معالجة ودراسة المرسوم التنفيذي 16/320 المتعلق بمنصب الأمين العام للبلدية، انطلاقا من تسميته وشروط تعيينه وفق معيار "حجم وعدد السكان"، وكذا تصنيفه ما بين ممارسة مهامه كوظيفة عليا ومنصب عال، ومن ثم وجود صنفين لنفس المنصب، ذلك أن هذا المرسوم، يهدف من وراء ذلك الى إسناد المهام الادارية في البلدية الى موظف يملك كفاءات، تؤهله الى الارتقاء بالعمل المحلي البلدي. غير أنه في مقابل ذلك أوجد هذا المرسوم نوعا من عدم الوضوح والتداخل في بعض الصلاحيات بين الأمين العام للبلدية ورئيس المجلس الشعبي البلدي، ومن ثم فالمرسوم في حاجة الى إعادة النظر وذلك بمعالجة قانونية شاملة ومضبوطة لمنصب الأمين العام في البلدية، وفي نفس الوقت إرساء توازن بين هيئات البلدية الثلاث وضبط وتحديد الصلاحيات بما يخدم في الأخير التنمية المحلية. This research paper dealt with the treatment and study of Executive Decree 16/320 related to the position of Secretary-General of the Municipality, based on his name and the conditions for his appointment according to the criterion of "size and number of population", as well as his classification between exercising his duties as a higher function and a high position, Hence the existence of two classes for the same position.This is because this decree aims to assign administrative tasks in the municipality to an employee who possesses competencies that qualify him to advance the local municipal work. However, on the other hand, this decree created a kind of lack of clarity and overlap in some powers between the Secretary-General of the Municipality and the President of the Municipal People's Assembly. Hence, the decree needs to be reconsidered, with a comprehensive and precise legal treatment of the position of the Secretary-General in the municipality, and at the same time establishing a balance between the three municipal bodies and controlling and defining the powers to ultimately serve local development.
