الملخص
ملخص: يعتبر مبدأ التكامل أحد أهم الأنظمة التي جاء بها النظام الأساسي للمحكمة الدولية، وذلك للجمع بين مدارين هامين هما: ضرورة المحافظة على مبدأ السيادة الوطنية للدول على أشخاصها وممتلكاتها من جهة، ومن جهة ثانية ضرورة ملاحقة ومحاكمة مجرمي الحرب نظير أفعالهم الإجرامية التي ارتكبوها، ومن ثمّ فمبدأ التكامل يعطي الأولوية في المتابعة والمقاضاة إلى الأنظمة الوطنية الجنائية ابتداء، غير أن ذلك لم يسلم من العقبات التي تحول دون تطبيق هذا المبدأ، الأمر الذي صعب نوعا ما من عملية المتابعة الدولية لبعض الجرائم المرتكبة من قبل بعض الأشخاص. Abstract: The principle of complementarity is one of the most important rules of the Statute of the International Tribunal, in order to combine two important courses: the need to preserve the principle of the national sovereignty of States over their persons and property; and on the other hand the need to prosecute and prosecute war criminals for their criminal acts, The principle of complementarity gives precedence to follow-up and prosecution of national criminal systems, but this has not eliminated the obstacles to the application of this principle, which has made it somewhat difficult for the international follow-up to certain crimes committed by certain persons.
