الحماية القانونية لمبدأ السر الطبي في النظام القانوني الجزائري

الملخص
تعد مهنة الطب من احدى المهن الأكثر اطلاعا على الحياة الخاصة بالأشخاص وذلك عن طريق التدخلات الطبية، لهذا فإن حماية الحياة الشخصية للأفراد وأسرارهم الخاصة سبب كاف لفرض واجب المحافظة على السر الطبي. ان اهم التزام يقع على عاتق الطبيب، هو الالتزام بالمحافظة على سر مهنته المتمثل أساسا في عدم افشاء ما يتعلق بمريضه سواء أخبره بذلك أو اكتشفه لوحده من خلال المعاينة والتشخيص. الا أن هناك حالات لا يلتزم فيها الطبيب بكتمان السر، بل يستوجب عليه الافشاء به، ويمكن أن ترجع هذه الحالات الى ما يتعلق بالإفضاء الوجوبي أو الى ما يتعلق بالإفضاء الجوازي. تتمثل أهمية هذه الدراسة في التعرف على مبدأ السرية الطبية، والاستثناءات التي قد ترد عليه، وتسليط الضوء على علاقة الثقة التي تقوم بين المريض والمؤتمن على السر الطبي، وكيفية الموازنة بين المصلحة الخاصة للمريض بحماية أسراره والمصلحة العامة للمجتمع لتحقيق العدالة. Abstract: Medical field is one of the most available profession that can consult and has an access to the personal and private life of people through medical intervention and examination. So the protection of the people’s privacy live is a reason to care about the medical secret. So the doctor’s duty in this way is to keep and preserve his job’s secret which consists on not revealing whatever concerns his patient whether he tells his or discovers it through medical checking and diagnosis. However, there are other situation where the doctor is not obliged not only to keep the secret but he must reveal it and these situation can be attributed to the duty to disclosure the secret or the permission to disclosure the secret. This study consists on knowing and identifying the principles of medical confidentiality and some exceptions that can be faced and also to improve the trust between the patient and this doctor and to balance the patient’s private interests by protecting his secrets and the public interest of a society to achieve the justice.
