ملخص: اعترف المؤسس الدستوري في الفصل 80 من دستور 2014، بسلطات واسعة لرئيس الجمهورية لمواجهة بعض الظروف غير العادية التي قد تعترض سلامة وأمن البلد ويطرح هذا البحث مشكلة التعرف مدى خروج الرئيس التونسي عن المشروعية الدستورية اثناء تنظيمه لهذه الحالة، إذ يتحدد نطاقه في البحث في التدابير الاستثنائية التي اتخذها الرئيس لتونسي والتي قسمت الطبقة السياسية وأساتذة القانون الدستوري حول مشروعيتها وخروجها عن حدود الدستور، من خلال استخدام المنهج التحليلي النقدي. حيث استهدفت الدراسة أساسا الوقوف توافر شروط الفصل 80، كما حاولت تبرير التدابير المتخذة في إطاره بناء على النظريات الفقهية المتعلقة بنظرية الظروف الاستثنائية وقد كشفت أنه رغم عدم موافقتنا للكثير من الإجراءات المتخذة في ظل هذه الحالة إلا أن هناك تيار فقهي يبرر الخروج عن القواعد الدستورية عند المساس بالمصلحة العليا للدولة وانتهت الدراسة إلى القول بضرورة عناية المؤسس الدستوري التونسي بصياغة وضبط المواد المتعلقة بالحالات الاستثنائية، وتقديم توصيات لإثراء وثيقة التعديل الدستور الجزائري والتونسي في التعديلات اللاحقة. الكلمات المفتاحية: مشروعية استثنائية، الرئيس التونسي، ظرف استثنائي، إرادة شعبية، الفصل 80 من دستور 2014. Abstract: In Chapter 80 of the 2014 Constitution, the Tunisian constitutional founder acknowledged the broad powers of the President of the Republic to confront some unusual circumstances that may hinder the safety and security of the country. The exceptional measures taken by the President of Tounsi, which divided the political class and constitutional law professors about their legitimacy, and their departure from the limits of the Constitution, through the use of the critical analytical method. Where the study aimed mainly to determine the availability of the conditions of Chapter 80, it also tried to justify the measures taken in its framework based on jurisprudential theories related to the theory of exceptional circumstances. compromising the supreme interest of the state. The study concluded that the Tunisian constitutional founder should pay attention to the formulation and control of articles related to exceptional cases, and to make recommendations to enrich the document of the amendment of the Algerian and Tunisian constitutions in the subsequent amendments.
