الضوابط الدستورية لتقييد حقوق وحريات الأفراد: ضمانة أساسية لحمايتها (دراسة مقارنة) Constitutional Controls To Restricting Rights And Freedoms Of Individuals: A Basic Guarantee For Their Protection (a Comparative Study)

الملخص
تهدف هذه الدراسة، لتسليط الضوء على موضوع حدود القواعد الدستورية المتعلقة بتقييد حقوق وحريات الأفراد (حدود التحديد) في عينة من الدول، فهي تعالج إشكالية حصانة "الحقوق والحرّيات" من كلّ تعسّف عند الحدّ منها من طرف السلطات العمومية. وقد كشفت من خلال اعتماد المنهج التحليلي، عن تجاوب المؤسس الدستوري الجزائري لسنة 2020، مع المطالب الحقوقية والتجارب المقارنة بإقرار ضمانات كثيرة للحقوق ومنها دسترة حدود تقييد المشرع لها، وهو ما يساهم في دعم ممارستها الذي يعد من أهم معالم دولة القانون، غير أنه وعلى خلاف الدستور التونسي، قد تكون الصياغات الوارد بها التقييد في بعض الدساتير مقتضبة، اعتمدت مفاهيم واسعة كالنظام العام والآداب العامة، الأمن...، بالإضافة إلى إغفال المؤسس الوطني النص على عنصري التناسب والضرورة، واللذين مِن خلالهما فقط نستطيع إدراك معقولية القيد الموضوع من المشرع؛ مما قد يمثل إفراغا لمضمونها. وانتهت إلى القول بضرورة العناية بصياغة القواعد الدستورية المتعلقة بحقوق الأفراد وحرياتهم وتقديم توصيات لإثرائها. الكلمات المفتاحية: المؤسس الدستوري؛ تقييد الحقوق؛ ضوابط المشرع؛ رقابة القيود؛ الدفع بعدم الدستورية. Abstract: This study aims to shed light on the issue of the limits of the constitutional rules related to the restriction of the rights and freedoms in a sample of countries. It addresses the problem of immunity of “rights and freedoms” from all abuse committed by the public authorities when they limited them. It revealed the response of the Algerian constitutional founder for the year 2020 to human rights demands and comparative experiences by adopting many guarantees for rights, including the constitution of the limits of the legislator’s restriction of them, and concluded by saying the need to pay attention to drafting constitutional rules relating to the rights and freedoms of individuals and to make recommendations to enrich them.
