الملخص
يتمحور الهدف من هذا المقال حول الإخطار كمعيار شكلي أولي تتم على ضوئه التفرقة بين رقابة المطابقة ورقابة الدستورية ورقابة الدفع بعدم الدستورية. لقد تبين من خلال النصوص المنظمة للإخطار ومن خلال تحليل آراء المجلس الدستوري وقراراته والمقارنة بينها أن الإخطار يتكون من عناصر متعددة: جهات الإخطار وشكله وطبيعته والهدف منه وملحقاته أو مرفقاته وأنها كلها معايير أولية للتميز بين الأنواع الثلاثة للرقابة. The aim of this article revolves around notification as a preliminary formal criteria in the light of which distinguishes between conformity control and constitutional control and control of the exception of unconstitutionality. Through the texts organizing the notification, and through analyzing the opinions and decisions of the Constitutional Council and comparing them, it was found that the notification consists of several elements: the notification bodies, shape, nature, purpose, annexes or attachments, and they are all primary criteria for distinguishing between the three types of control.
