موقف المشرع الجزائري من شرط الثبات التشريعي في عقود الإستثمار الأجنبي

الملخص
يهدف هذا البحث إلى إبراز موقف المشرع الجزائري من أحد الشروط التي تعتبر ذات أهمية كبرى في مجال العقود الاستثمارية الأجنبية في أي دولة كانت من دول العالم ، و هو شرط الثبات التشريعي في الدولة المستضيفة للاستثمار ، و كما يقال في عالم الاقتصاد فإن المال المستثمر جبان ، و بالتالي فإن صاحبه يخاف عليه من تغيير التشريعات في الدول المستضيفة له ، و بالتالي ضياعه عن طريق التأميم . و عليه سنحاول في هذا البحث إبراز هذا الموقف من خلال التطرق في البداية إلى الإطار التنظيمي لشرط الثبات التشريعي ، تم التعرض إلى مدى تكريسه من طرف المشرع الجزائري ، لنخلص في النهاية إلى أنه رغم اعتماد المشرع الجزائري لهذا الشرط في عقود الاستثمار الأجنبي ، إلا أن كثرة التعديلات الواردة على قانون الاستثمار و القوانين المرتبطة به ، جعلت المستثمرين يخافون من عدم الاستقرار هذا ، و بالتالي لا يرغبون في المجيء للجزائر من اجل الاستثمار فيها . The aim of this research is to highlight the position of the Algerian legislator on one of the conditions that are of great importance in the field of foreign investment contracts in any country that is in the world, and is the condition of legislative stability in the country hosting investment, and as it is said in the economic world, the invested money is good. The author therefore feared that he would change the legislation in the host countries and thus lose it through nationalization. In this research we will try to highlight this position by initially addressing the regulatory framework of the legislative stabilization clause, and it has been dedicated to the extent of its allocation by the Algerian legislature, to conclude that although the Algerian legislature has adopted this requirement in foreign investment contracts, However, the many amendments to the investment law and related laws have made investors fear this instability and therefore do not want to come to Algeria to invest in it.
