التصديق الالكتروني آلية تقنية لضمان وحماية المعاملات التجارية الإلكترونية في القانون الجزائري

الملخص
يبين هذا البحث بالدراسة والتحليل دور التوثيق والتصديق الالكتروني في ضمان وتفعيل المعاملات التجارية الالكترونية وكذلك حماية المستهلك الالكتروني، حيث أنه وتدعيما لمصداقية التجارة الالكترونية وتوفير الثقة و الأمان بين المتعاملين بالوسائط الالكترونية، استحدث المشرع آليات تتولى عملية حماية البيانات والمعلومات المتبادلة إلكترونيا، خاصة في ظل تفشي وباء كورونا، واتخاذ الدول لإجراءات احترازية كالتباعد الجسدي والحجر المنزلي بغية الحد من انتشار المرض. الأمر الذي دفع بالمستهلك والتاجر إلى اللجوء إلى فضاء افتراضي للشراء والبيع، والذي استدعى وجود طرف ثالث موثوق ومحايد، يسمى بمؤديي خدمات التصديق الالكتروني، يقوم بإصدار شهادة الكترونية تؤكد شخصية المرسل والتحقق من صحة التوقيع الالكتروني، هذا ما يبرر أهمية دراسة آلية التصديق الالكتروني وبيان دورها في ضمان العقود التجارية الالكترونية وحماية المستهلك الالكتروني، وقد توصلنا في نهاية البحث إلى بيان أهمية شهادة التصديق الالكتروني في التعامل التجاري الالكتروني. This research shows, by study and analysis, the role of electronic authentication and authentication in ensuring and activating electronic commercial transactions as well as electronic consumer protection, as it is in support of the credibility of electronic commerce and in order to provide confidence and security among dealers with electronic media, the legislator has developed mechanisms that undertake the process of protecting data and information exchanged electronically, especially in light of the outbreak of the epidemic. Which prompted the consumer and the merchant to resort to a virtual space for buying and selling, which necessitated the presence of a trusted and neutral third party, called the providers of electronic certification services, to issue an electronic certificate confirming the identity of the sender and verifying the validity of the electronic signature, This justifies the importance of studying the electronic certification mechanism and its role in ensuring electronic commercial contracts and electronic consumer protection.
