الملخص

الأسرة هي المؤسسة الاجتماعية الأولى التي ينمو فيها الطفل ويكتسب من خلالها معايير الخطأ والصواب، والحدث هو ثمرة صلاح وتماسك هذه الخلية، بحيث إذا كانت هذه الأخيرة خالية من كل عوامل التفكك الأسري والإهمال، فإن الحدث ينمو في هذه الخلية نموا سليما وينتهج السلوك القويم داخل المجتمع، وإذا فسدت هذه الخلية نتج عن ذلك نمو الحدث في جو عائلي متوتر ويسوده الإهمال في بعض حقوقه أو كلها مما يؤدي به إلى انتهاج السلوك الجانح داخل المجتمع. ونظرا لكون الطفل من الفئات الضعيفة التي خصها المجتمع والتشريعات بمعاملة خاصة وحماية خاصة في إطار التشريعات الجنائية والتي تأكدت من خلال قانون العقوبات وقانون الإجراءات الجزائية وصولا إلى وضع تشريع خاص بحماية الطفل بموجب القانون 15/12، سعيا لحماية الطفل وإصلاح الحدث الجانح وعلاجه. Abstract: The family is the first social institution in which the child grows and acquires the criteria of error and righteousness, and the event is the fruit of the goodness and cohesion of this cell, so that if the latter is free from all factors of family disintegration and neglect, then the event grows in this cell a sound growth and adopts the right behavior within society And if this cell becomes spoiled, the result of this is the growth of the juvenile in a tense family atmosphere and neglecting some or all of his rights, which leads him to adopt delinquent behavior within society. And given that the child is one of the vulnerable groups that have been allocated by society and legislation with special treatment and protection within the framework of criminal legislation and that have been confirmed through the Penal Code and the Code of Criminal Procedures, leading to the development of legislation on child protection under Law 15/12, in an effort to protect the child and reform and treat the juvenile delinquent.
