الملخص
يعتبر العنف الأسري من أخطر أنواع العنف على الاطلاق، لأنه يمس بركيزة المجتمع وهي الأسرة، هذه الأخيرة كانت ولازالت المصدر الذي يستمد منه الفرد قـوتــه ومكانتـه الاجتماعية وشخصيته، لكن هذا الكلام المثالي أصـبح اليوم يصطدم بحقائق الواقع، هذا الأخير الذي اختلت فيه وظائف الأسرة فأصبحت مصدر إزعاج وتهديد حتى لأضعف أفرادها وهم الأطفال، لهذا جاءت مختلف التشريعات الوضعية من بينها المشرع الجزائري بنصوص خاصة تجرمّ كل أفعـال العنف الواقعة على الأطفال مهما كان نوعه، وبين واجب المشرع في حماية الأطفال من جرائم العنف من جهة، ورغبته في الحفاظ على كيان الأسرة من جهة أخرى، إلى أي مدى وفق في بسط الحماية الجنائية للطفل وردع الأسرة عن الاخلال بوظائفها الواجبة نحو أطفالها؟. Family violence is considered one of the most dangerous types of violence at all, because it affects the social structure of the family. The latter is the source of the individual's strength, social status and personality. However, this idealism is now confronted with the realities of the family. The legislators, including the Algerian legislator, have introduced special provisions that criminalize all acts of violence against children of any kind, and the legislator's duty to protect children from violent crimes on the one hand, and his desire to preserve the family's identity. On the other hand, to what extent is it in extending the criminal protection of the child and deterring the family from violating their due functions towards their children?
