الملخص
يعتبر دستور2020 أول دستور جزائري يقر للمحكمة الدستورية وضع نظامها الداخلي ويمنحها أيضا سلطة وضع النظام المحدد لقواعد عملها. وإذا كان هذا النظام الأخير ليس نظاما داخليا بالمعايير التي حددها المجلس الدستوري بمناسبة رقابته لمطابقة الأنظمة الداخلية لغرفتي البرلمان، فهو إذن تشريع بحسب الأصل وبحسب الدساتير المقارنة. لكن به عوار ونقائص كثيرة أهمها مخالفته للقانون العضوي رقم 22-19 ومخالفته الصريحة للدستور. الأمر الذي يستلزم تعديل الدستور وإعادة صياغة أحكام النظام المحدد لقواعد عمل المحكمة الدستورية بموجب قانون عضوي وليس بموجب نظام صادر عن المحكمة الدستورية. Abstract: The constitution of 2020 is considered the first Algerian constitution that authorizes the Constitutional Court to set its internal regulation and also grants it the authority to set the regulation that defines the rules of its work. And if this last regulation is not an internal regulation with the standards set by the Constitutional Council on the occasion of its control of the conformity of the internal regulations of the two chambers of the Parliament, it is, then, legislation according to the origin and according to comparative constitutions. However, it has many flaws and shortcomings, the most important of which is its violation of Organic Law No. 22-19 and its explicit violation of the Constitution. This necessitates amending the constitution and reformulating the provisions of the regulation that defines the rules of the Constitutional Court’s work by virtue of an organic law and not by a regulation issued by the Constitutional Court.
