الأساس الدستوري والقانوني للنصوص القانونية المنظمة للمحكمة الدستورية الجزائرية The Constitutional And Legal Basis Of The Legal Texts Regulating The Algerian Constitutional Court

الملخص
رغم ان الدستور الحالي 2020 باعتباره الأساس القانوني الرئيس للمحكمة الدستورية قد نظمها من كل الجوانب إلا أن هناك مجموعة نصوص قانونية صدرت عن سلطات مختلفة تناولت أحكاما تتعلق بهذه المحكمة. ويهدف هذا المقال إلى دراسة الأساس الدستوري والقانوني لهذه النصوص. لقد تبين أن بعضا منها ليس له أساس دستوري، وأن البعض الآخر رغم وجود ذلك الأساس فقد صدر النص مشوبا بنقائص واختلالات، وبعضها يتعارض عنوانه مع مضمونه ومحتوياته. كما تبين من خلال تحليل هذه النصوص والمقارنة بينها أنها تحتوي على مضامين وأحكام متناقضة ومكررة، وأن معظمها تنقصه المنهجية القانونية في صياغة أحكامها، مما يحتم ضرورة تعديل بعض مواد الدستور وإعادة صياغة الأحكام المتعلقة بالمحكمة الدستورية في قانون عضوي بديلا عن تلك النصوص المختلفة، نظرا لما يحققه القانون العضوي من إيجابيات وضمانات للمحكمة الدستورية. الكلمات المفتاحية: الأساس- الدستور- النصوص- المحكمة الدستورية Abstract: Although the current constitution of 2020, as the main legal basis for the Constitutional Court, has regulated it in all aspects, there are a number of legal texts issued by various authorities that deal with provisions related to this court. This article aims to study the constitutional and legal basis for these texts. It turned out that some of them do not have a constitutional basis, and that others, despite the existence of that basis, the text was tainted with deficiencies and imbalances. Some of them are in conflict with the title and its contents. It was also found through analyzing and comparing these texts that they contain contradictory and repetitive contents and provisions, and that most of them lack legal methodology in formulating their provisions. This necessitates the need to amend some articles of the Constitution and reformulate the provisions related to the Constitutional Court in an organic law as a substitute for these different texts, due to the advantages and guarantees achieved by the organic law for the Constitutional Court.
