الملخص
ترمي الورقة البحثية إلى دراسة قواعد عمل المحكمة الدستورية حال ممارستها لاختصاصاتها الدستورية والقانونية المتعلقة بمجال رقابة الدستورية والمطابقة للدستور بغية توضيح مختلف إجراءات سيرها في ظل الضوابط التي حددتها النصوص القانونية لاسيما النظام الداخلي لعمل المحكمة الدستورية لسنة 2023. ولقد حاولنا من خلال هذه الدراسة التطرق إلى الأحكام القانونية المنظمة لطريقة عمل المحكمة الدستورية في مجال الرقابة والمطابقة الدستورية انطلاقا من يوم احالة القانون عليها بموجب الاخطارات المقدمة من احدى الجهات الدستورية أو بموجب الدفوع بعدم الدستورية المثارة من طرف الأفراد أمام الجهات القضائية. كل ذلك كان من خلال تتبع الاجراءات التي تتولاها المحكمة الدستورية التي تبدأ بتسجيل الاخطارات أو الدفوع بعدم الدستورية لدى أمانة الضبط وتنتهي بصدور قرارات وآراء المحكمة بشأنها ثم نشرها في الجريدة الرسمية مرورا بعملية تعيين مقرر أو أكثر للتحقيق بشأنها. The present paper aims to study the rules of work of the Constitutional Court when it exercises its constitutional and legal competences related to the field of constitutional oversight and compliance with the constitution in order to clarify the various procedures for its conduct under the controls set by the constitutional and legal texts; especially the internal system for the work of the Constitutional Court for the year 2023. Through this study, the researcher tried to address the legal provisions regulating the way the Constitutional Court works in regard to constitutional oversight and conformity, beginning with the law referred to according to the notifications submitted by one of the constitutional authorities, or according to the defenses of unconstitutionality raised by individuals before the judicial authorities. All of this was done by tracking the procedures undertaken by the Constitutional Court, which begins with the registration of notifications or defenses of unconstitutionality with the regulatory secretary, and ends with the issuance of decisions and opinions of the court regarding them, then publishing them in the Official Government’s journal through the process of appointing one or more rapporteurs to investigate them.
