الملخص
يهدف هذا المقال إلى دراسة خضوع الأوامر لرقابة الدفع بعدم الدستورية مثلها مثل القوانين العادية تنظم الحقوق والحريات طبقا للدستور الجزائري. لقد تبين أن النص الدستوري والقانون العضوي والمجلس الدستوري لم يحددوا بدقة النصوص التي تخضع للدفع بعدم الدستورية. وأن من أهم نتائج الدراسة خضوع الأوامر لرقابة الدفع بعدم الدستورية لكثرة الحقوق والحريات المنظمة بموجبها، وأن الأوامر في الجزائر لم تنظم الحقوق والحريات فحسب بل تناولت بالتنظيم أهم التقنينات الأساسية كتقنين الاجراءات الجزائية والتقنين الجنائي والتقنين المدني والتقنين التجاري، وأن القضايا التي عرضت على المجلس الدستوري في الدفع بعدم الدستورية تتعلق بأوامر وليست قوانين عادية. This article aims to study ordinances that are subject to the exception of unconstitutionality, just as ordinary laws regulate rights and freedoms in accordance with the Algerian constitution. It has been shown that the constitutional text, the organic law and the Constitutional Council did not specify the exact texts that are subject to the exception of unconstitutionality. That one of the most important results of the study is that ordinances are subject to control of the exception of unconstitutionality, due to the large number of rights and freedoms regulated accordingly. Algerian ordinances not only regulated rights and freedoms, but also concerned the most important codes such as the code of criminal procedure, the penal code, the civil code and the commercial code, and that the issues which have been brought before the Constitutional Council for exception of unconstitutionality concern ordinances, not ordinary laws.
