الملخص
يهدف هذا المقال إلى دراسة آليات رقابة المطابقة على النصوص القانونية التي يمارسها المجلس الدستوري الجزائري. لقد تبين من خلال تحليل نصوص التعديل الدستوري2016 وآراء المجلس الدستوري أن هناك آليات حددها الدستور لرقابة المطابقة منها الاخطار الوجوبي والقوانين العضوية والنظام الداخلي لغرفتي البرلمان. وأن القوانين المتضمنة التعديلات الدستورية يجب أن تخضع لرقابة أشد من رقابة المطابقة. وأن المجلس الدستوري قد استحدث آليات لرقابة المطابقة تجعلها رقابة صارمة وشاملة تنصب على كل النص من أول تأشيراته إلى غاية آخر مادة. This article aims to examine the mechanisms of conformity control on the legal texts practiced by the Algerian Constitutional Council. The analysis of the provisions of the Constitutional Amendment 2016 and the opinions of the Constitutional Council have shown that there are mechanisms established by the Constitution to monitor compliance, including the obligatory notification, the organic laws and the internal rules of the two chambers of Parliament. Laws containing constitutional amendments should be subject to tighter control than compliance. The Constitutional Council had introduced mechanisms to monitor conformity that would make it strict and comprehensive control focusing on the entire text from its first visas to the end of the last article.
