مدى حرية سلطة رب العمل في تعديل أجر العامل في ظل التداعيات الاقتصادية لوباء كورونا على الحركة التجارية للمؤسسة

الملخص
بإعلان منظمة الصحة العالمية بأن فيروس كورونا وباء عالمي –جائحة-إتخذت معظم الدول بما فيها الجزائر إجراءات تقيدية للحد من إنتشار الوباء ، تمثلت هذه الإجراءات في تدابير الحجر الصحي و بموجب هذه الأخيرة تم إغلاق الكثير من النشاطات الاقتصادية ، تلى هذا الغلق تراجع الحركة التجارية لهذه المؤسسات مما دعاها إلى إعادة مراجعة عقود العمل وتعديل أجر عمالها حماية لوضعها الاقتصادي ، والتقليل من الخسائر المترتبة على هذا الإغلاق. ولأن عقد العمل يحضي بخصوصية خاصة ضمن المنظومة العقدية ،فقد أحاط المشرع هذا العقد بقواعد حمائية للعامل في مواجهة أي تجاوز لرب العمل وبالمقابل أعطى لهذا الأخير سلطة في إتخاذ ما يراه مناسبا لحماية نشاطه الاقتصادي . من هذا المنطلق يهدف هذا الموضوع إلى دراسة مدى حرية سلطة رب العمل في تعديل أجر العامل على ضوء التداعيات الاقتصادية لوباء كورونا على النشاط التجاري للمؤسسة. Abstract: With the announcement by the World Health Organization that the Coruna virus is a global epidemic - a pandemic - most countries, including Algeria, have taken restrictive measures to limit the spread of the epidemic. These measures have been in quarantine measures, and according to the latter many economic activities have been closed. The institutions, which called on them to re-review work contracts and adjust the wages of their workers to protect their economic situation, and reduce the losses resulting from this closure. Because the labor contract entails a special privacy within the contract system, the legislator has surrounded this contract with protective rules for the worker in the face of any abuse by the employer, and in return has given the latter authority to take what is appropriate to protect his economic activity. From this standpoint, this topic aims to study the extent of freedom of the employer to adjust the wages of the worker in the light of the economic implications of the Corona epidemic on the business activity of the corporation.
