التدابير التكنولوجية لحماية المصنف وتأثيرها على الحق في النسخة الخاصة ومدى امتداد هذا التأثير على النسخة المثبتة على تقنية البلوك تشين

الملخص
تعاني حقوق المؤلف أزمة حادة في ظل الانتهاك الصارخ لها عير شبكة الانترنت، و أمام عجز النصوص القانونية في توفير حماية لحقوق المؤلف على شبكة المعلومات، تأتي الحماية التقنية يعول عليها لحماية المصنفات الرقمية، فيعمد المؤلف في حماية مصنفاته الرقمية بتدابير حماية تكنولوجية تمنع النسخ غير المشروع، و هذا الإجراء مشروع قانونا، بيد أن هذه التدابير تأثير على الحق في النسخة الخاصة التي أقرها المشرع لصالح المجتمع، ومن جهة أخرى ظهرت تقنية البلوك تشين لحفظ وحماية وإدارة حقوق المؤلف، وضمان عدم إحداث أي تشويه في المصنف أو حقوقه المالية. ومن نتائج الدراسة هو عدم وجود توازن بين الحماية التقنية للمصنفات والحق في استعمال النسخة الخاصة، لذا ينبغي البحث عن أليات توفيقية بين التدابير التكنولوجية وحق النسخة الخاصة، :Copyright suffers a severe crisis in light of the blatant violation of it on the Internet, and in the face of the inability of legal texts to provide protection for these rights on the information network, technical protection comes reliable to protect digital works, so the author deliberately protects his digital works with technological protection measures that prevent illegal copying And this procedure is a draft law, but these measures affect the right to the special copy approved by the legislator for the benefit of society, and on the other hand, the blockchain technology has emerged to preserve, protect and manage copyright rights, and to ensure that no distortion is caused in the work or its financial rights. One of the results of the study is the lack of balance between the technical protection of works and the right to use the special copy, so it is necessary to search for reconciling mechanisms between technological measures and the right of the special copy.
