أثر طبيعة المعرفة الفنية على وسيلة حماية سريتها

الملخص
تهدف هذه الدراسة إلى إبراز أهمية حماية سرية اللباقة الفنية والتي تعرف أيضا بالمعرفة الفنية كأساس لنقل التكنولوجيا ، لأن اللباقة الفنية تعتمد أولا على السرية كأساس للإستئثار بمعنى أن المعلومات التي تتضمنها ليست معروفة أو متداولة بشكل عام لدى المشتغلين بالفن الصناعي التي تقع المعلومات في نطاقه ، وثانيا أن القيمة الاقتصادية لهذه المعارف تستمد من كونها سرية ، وثالثا أن إستمرار الاستئثار بها يعتمد على إستمرار سريتها لذلك يبذل أصحابها جهدا للحفاظ على إستمرار سريتها من خلال إتخاذ مختلف إجراءات الحماية التي تتناسب وطبيعة هذه الأسرار. ولأن المعرفة الفنية لا تستند الى سند مادي كحقوق الملكية الصناعية الاخرى فإن الحماية المخولة فإن الحماية المخولة لها هي تلك التي تمنحها المنافسة غير المشروعة. This study aims to highlight the importance of protecting the confidentiality of technical tact, also known as technical knowledge as a basis for technology transfer, because technical tact depends first on confidentiality as a basis for procrastination in the sense that the information that it contains is not known or value of this knowledge derives from the fact that it is confidential, and third, that the continuation of the monopoly depends on the continuity of confidentiality, so the owners make an effort to maintain the continuity of confidentiality through the adoption of various protecting measures which commensurate with the nature of these secrets. Because technical knowledge is not based on a material bond like other industrial property rights, the protection granted to it is that granted by the competition of illegal.
