تنفيذ أحكام التحكيم التجاري وفقاً للاتفاقيات الدولية و أحكام قانون الإجراءات المدنية والإدارية الجزائري

الملخص
ويهدف هذا البحث إلى تبيان كيف يتم تنفيذ حكم التحكيم التجاري الدولي، و إجراءاته، وفق لأحكام القانون الجزائري، ووفق لأحكام الاتفاقيات الدولية. وخلصت النتائج إلى أن المشرع الجزائري يفصل في مسألة تنفيذ حكم التحكيم التجاري الدولي، ففصل بين حكم التحكيم التجاري الدولي الصادر في الخارج ويراد تنفيذه في الجزائر، وحكم التحكيم التجاري الدولي الصادر في الجزائر. حيث حصن المشرع الطعن في حكم التحكيم التجاري الدولي المراد تنفيذه في الجزائر، حيث أجاز المشرع الطعن في القرار بقبول أو رفض التنفيذ. This research aims to show how the international commercial arbitration award and its procedures are implemented, in accordance with the provisions of Algerian law, and in accordance with the provisions of international agreements. The results concluded that the Algerian legislator separates the issue of implementing the international commercial arbitration award, separating between the international commercial arbitration award issued abroad and intended to be implemented in Algeria, and the international commercial arbitration award issued in Algeria. Where the legislator has immunized the challenge of the international commercial arbitration award that is to be implemented in Algeria, where the legislator has permitted the challenge of the decision to accept or reject the implementation.
