الوظائف الضّبطيّة لمجلس المنافسة الجزائري

الملخص
في إطار تحّول وظيفة الدّولة إلى دولة ضابطة للاقتصاد، أنشأ المشرّع الجزائريّ سلطة ضبط اقتصاديّ تعنى بضبط المنافسة في الجزائر، تسمّى مجلس المنافسة، وأناط بها في سبيل ذلك مجموعة من الوظائف تتراوح بين وظائف غير تنازعيّة تتمثّل في الوظيفة الاستشاريّة والتّنظيميّة ووظيفة الرّقابة على التّجميعات الاقتصاديّة والإشراف على النّشرة الرّسميّة للمنافسة، ووظيفة تنازعيّة مفادها الفصل في الدّعاوى التّي يخطر بها بشأن الممارسات المقيّدة للمنافسة، وهو ما يجسّد الطّابعين السّلطوي والإداري للمجلس مع تمكينه من الاستقلاليّة العضويّة من خلال الطّابع الجماعي والمختلط والمتخصّص لتشكيلته، والاستقلاليّة الوظيفيّة من خلال عدم تبعيّته أو خضوعه لأيّ جهة عند ممارسته للوظائف المنوطة به. In the context of the transformation of the state’s function into a state controlling the economy, the Algerian legislator established an economic control authority concerned with controlling competition in Algeria, called the Competition Council. The regulatory and function of oversight over economic groupings and supervision of the official competition bulletin, and a litigious function that is to decide the cases notified to it regarding practices restricting competition, which embodies the authoritarian and administrative nature of the council while enabling it to be independent through its formation and functional autonomy through the collective nature of Not being affiliated with or subordinated to any party when performing the functions entrusted to him.
