الوضع القانوني للمرتزقة وموظفي الشركات العسكرية والأمنية الخاصة

الملخص
لقد حددت اتفاقية لاهاي الثانية لعام 1899، المتعلقة بقوانين وأعراف الحرب البرية والملحق التابع، أطراف النزاعات المسلحة وحددتهم في: الجيوش النظامية التابعة لأحد الأطراف المتحاربة، وكذلك مجموع المليشيات والمتطوعين الذين يحملون شارات مميزة لهم. لكن من المظاهر البارزة التي شهدتها النزاعات المسلحة، سواء أكانت دولية أم غير دولية، لا سيما منذ النصف الثاني من القرن الماضي حتى يومنا هذا، هو الدور الكبير والمؤثر للمرتزقة في هذه الأحداث، وهذا الدور لا يقتصر على حسم النزاع لصالح أحد الأطراف المتحاربة، بل يتعدى ذلك إلى طبيعة النشاط الذي يقوم به المرتزقة في ميادين القتال، وبالمقابل أثار دور الشركات المشاركة في القتال اهتماما دوليا، خاصة حول المتعاقدين العسكريين من القطاع الخاص من حيث قيامها بوظائف كانت تنجزها أجهزة الدولة الأمنية والعسكرية. وهنا يجب البحث عن الوضع القانوني الوضع القانوني للمرتزقة وموظفي الشركات العسكرية والأمنية الخاصة. Abstract : The Second Hague Convention of 1899, relating to the laws and customs of land war and the subordinate annex, defined the parties to armed conflicts and identified them in: the regular armies of one of the warring parties, as well as the group of militias and volunteers with distinctive emblems. But one of the prominent manifestations of armed conflict, whether international or non-international, especially since the second half of the last century to the present day, is the large and influential role of mercenaries in these events, and this role is not limited to resolving the conflict in favor of one of the warring parties, but rather This exceeds the nature of mercenary activity in the battlefields, and in return the role of the companies involved in the fighting has aroused international interest, especially around military contractors from the private sector in terms of carrying out jobs that were performed by the state's security and military services. Here, we must search for the legal status of the legal status of mercenaries and employees of private military and security companies should be souught.
