الوضع القانوني لموظفي الشركات العسكرية والأمنية الخاصة بين المشروعية الدولية والارتزاق العسكري

الملخص
رغم محاولات المجتمع الدولي من الحد لظاهرة المرتزقة وتجريمها، إلا أن بعض الدول والأنظمة والحكومات تجد في المرتزقة وسيلة مجدية لتحقيق مصالحها، ولهذا نرى أن للمرتزقة دوراً كبيراً وخطيراً في الحروب والنزاعات المسلحة الدائرة حالياً، والتطور اللافت في هذه الظاهرة أن الكثير من الشركات العسكرية والأمنية الخاصة، تلجأ لاستخدام وتشغيل هذه الفئة ضمن موظفيها، ولاسيما بعد احتلال أفغانستان والعراق، أين أخذت الظاهرة في الانتشار على أوسع نطاق، فمن خلال هذه الدراسة نحاول تسليط الضوء على هذه الظاهرة الخطيرة، وتوضيح الوضع القانوني لموظفي الشركات العسكرية والأمنية الخاصة، وتمييزها أو مدى انطباق وصف المرتزقة على هؤلاء وفق التطورات الراهنة اثناء النزاعات المسلحة سواء الدولية أو غير الدولية. الكلمات المفتاحية: موظفو الشركات العسكرية والأمنية الخاصة-الشركات العسكرية والأمنية الخاصة -المرتزقة –النزاعات المسلحة. Abstract Despite attempts by the international community to reduce the phenomenon of mercenaries and criminalized, but some states and regimes and governments find mercenaries and a viable means of achieving their interests, and therefore we believe that the mercenaries great and serious role in the wars and armed conflicts of today, and the development is striking in this phenomenon is that a lot of private military and security companies , resort to the use and operation of this category within its staff, especially after the occupation of Afghanistan and Iraq is beginning to take this activity, it is through this research paper, we try to shed light on this dangerous phenomenon, and to clarify the legal status of the staff of the private military and security companies And distinguish them or the applicability of the description of these mercenaries and this according to current developments during both international armed conflict or non-international.
