ضمانات القانون الدولي لحق الشعب الفلسطيني في تقرير مصيره

الملخص
يعتبر حق تقرير المصير حقا قانونيا يكون بمقتضاه لكل شعب الحق الكامل في تقرير مصيره، واختيار نظامه السياسي والاقتصادي والاجتماعي، وبالتالي بسط سيادة هذا الشعب على الإقليم الذي يقيم عليه دون تدخل أجنبي. وبالنسبة للقضية الفلسطينية فإنه بداية من قرار الأمم المتحدة رقم 181 عام 1947 القاضي بالتقسيم، والذي قرر إقامة دولتين عربية ويهودية على أرض فلسطين وما تبعه من قرارات، إلى غاية عام 1969 أصبحت القضية تعالج من منطلق حق الشعب الفلسطيني في تقرير المصير. وتتمحور إشكالية المقال حول الأسانيد القانونية الدولية التي تكرس حق الشعب الفلسطيني في تقرير مصيره، أما عن أهم النتائج المتوصل إليها؛ فتتمثل في أن حق تقرير المصير هو حق الشعب في حرية تقرير مركزه السياسي ومكانته في المجتمع الدولي، وأن كل انتهاك له هو انتهاك للسلم والأمن الدوليين، وأن بإدراجه في ميثاق الأمم المتحدة أصبح من المبادئ الأساسية للجماعة الدولية. Abstract: The right to self-determination is a legal right according to which all people have the full right to self-determination, to choose their political, economic and social system, and thus to extend the sovereignty of this people on the area on which they reside without interference foreign.As for the Palestinian question, it starts from the resolution n° 181 of 1947 of the United Nations, which prescribes the partition, which decided to create two Arab and Jewish states on the land of Palestine and the subsequent decisions, until 1969, the issue was addressed in terms of the right of the Palestinian people to self-determination. The problem of the article revolves around the international legal foundations which enshrine the right of the Palestinian people to self-determination. As for the most important conclusions, it is that the right to self-determination is the right of the people to freedom to determine their political status and their position in the international community.And that any violation of it is a violation of international peace and security, and that its inclusion in the Charter of the United Nations has become one of the fundamental principles of the international community. .
