Regard Sur Certains Aspects De La Qualité Institutionnelle De La Régulation économique En Algérie

Résumé
Résumé : La présente recherche vise à déterminer, selon une approche juridique, dans quelle mesure la régulation économique, en tant que nouvelle forme d'intervention publique dans l'économie basée sur le retrait de l'État de la gestion directe de l’activité économique au profit d'une présence indirecte dans laquelle il se contente d’exercer le rôle d’un arbitre qui définit les règles du jeu libre de la concurrence et veille à leur respect par les agents économiques qu'ils soient publics ou privés, dispose d’une qualité institutionnelle qui répond aux attentes du milieu économique. L’étude a conclu quelques résultats, qui peuvent être résumés dans l'existence de certaines contraintes juridiques auxquelles est confrontée l'indépendance organisationnelle et fonctionnelle des organes de régulation vis-à-vis du pouvoir exécutif, d'une part, et leur impartialité lors de l’exercice de leur pouvoir de sanction à l’égard des agents économiques, d'autre part, ce qui réduirait la qualité institutionnelle de cette fonction et sa capacité à atteindre ses objectifs efficacement. ملخص: يهدف البحث إلى الوقوف، من خلال مقاربة قانونية، على مدى تمتع الضبط الاقتصادي كشكل جديد للتدخل العمومي في الاقتصاد يرتكز على انسحاب الدولة من التسيير المباشر للنشاط الاقتصادي لصالح حضور غير مباشر تكتفي فيه بدور الحكم الذي يقوم فقط بتحديد قواعد اللعبة الحرة للمنافسة والسهر على احترامها من الأعوان الاقتصاديين عموميين أو خواص، بجودة مؤسساتية تستجيب لطموحات وتطلعات الوسط الاقتصادي. وقد تم الركون منه إلى عدة نتائج، أخصها معاينة وجود بعض الإكراهات القانونية التي تواجه الاستقلالية التنظيمية والوظيفية لهيئات الضبط في مواجهة السلطة التنفيذية، من جهة، وحيادها عند ممارسة سلطتها العقابية في مواجهة الأعوان الاقتصاديين، من جهة ثانية، الأمر الذي من شأنه الحد من الجودة المؤسساتية لهذه الوظيفة ومن قدرتها على تحقيق أهدافها بفعالية. Abstract: This research aims to determine, according to a legal approach, to what extent economic regulation, as a new form of public intervention in the economy based on the withdrawal of the State from the direct management of economic activity in advantage of an indirect presence in which it is content to exercise the role of an arbiter who defines the rules of the free game of competition and ensures that they are respected by economic agents, whether public or private, has an institutional quality that meets the expectations of the economic community. The study concluded some results, which can be summarized in the existence of certain legal constraints facing the organizational and functional independence of the regulatory bodies vis-à-vis the executive power, on the one hand, and their impartiality when exercising their power to sanction economic agents, on the other hand, which would reduce the institutional quality of this function and its ability to achieve its objectives effectively.
