الملخص
ملخص: يشكل نظام التربص في الوظيفة العمومية، آلية تصحيحية ومكملة لنظام المسابقة في التوظيف، تهدف إلى الكشف عن مدى الصلاحية الفعلية للعون المعين في النهوض بمهام وظيفته قبل ترسيمه في رتبة من رتب السلم الإداري، لذلك، يعتبر العون المتربص موظفا مستقبليا أو بحسب المآل، مما يعطيه وضعية قانونية خاصة مقارنة بالموظف المرسم، تظهر أساسا على صعيد تواجده في مركز قانوني وتنظيمي، وعلى صعيد عدم الاستقرار النهائي لمركزه القانوني. تحاول الدراسة البحث في مدى ضمان الإطار القانوني للعون المتربص تحقيق التوازن بين هذين المعطيين في وضعيته القانونية. Abstract: the training system in the public service is a corrective and complementary mechanism to the competition system in recruitment, aimed at revealing the effective appetite of the appointed agent to perform his duties before his appointment to a rank of the administrative hierarchy, consequently, the trainee agent is considered as a future agent, which confers on him a specific legal situation in relation to the tenured agent, translated into its legal and regulatory situation, and into the ultimate instability of this situation. The study attempts to examine the extent to which the trainee's legal framework balances these two elements in his legal situation.
