الملخص
الملخص: يعتبر مرفق العدالة من أهم المرافق السيادية في الدولة، وظيفته الحفاظ على الانسجام داخل المجتمع، من خلال الفصل طبقا للقانون في المنازعات التي قد تثور في الحقل الاجتماعي، لذلك يتعين أن يتميز ابتداء بجودة مؤسساتية، تظهر على صعيد تمتعه بالاستقلالية في مواجهة المكونات الأخرى للثلاثية الدستورية في الدولة، لاسيما السلطة التنفيذية، وعلى صعيد مدى جواريته بالنسبة للمتقاضين سواء في بعدها الجغرافي أو الشامل. تهدف الدراسة إلى بحث هذه المتطلبات المؤسساتية لجودة العدالة وإسقاطها على واقع النظام القانوني الجزائري، وذلك بغية تشخيص الاختلالات التي تعتريها وتقديم الحلول المناسبة لمعالجتها. Abstract: The justice service is considered one of the most important sovereign services in the state, and its function is to maintain harmony within society, through separation according to the law in disputes that may arise in the social field, therefore it should be distinguished first from institutional quality, which appears on the level of its independence in the face of other components of the constitutional tripartite In the state, especially the executive branch, and in terms of its proximity to litigants, whether in its geographical or overall dimension. The study aims to examine these institutional requirements for the quality of justice and to bring it down to the reality of the Algerian legal system, in order to diagnose the imbalances in it and provide appropriate solutions to address them.
