دور وكالتي المحروقات في ضبط نشاطات المحروقات في ظل القانون رقم 19-13

الملخص
إن قطاع المحروقات يمثل عصب الاقتصاد الجزائري من حيث المداخيل وحجم الاستثمارات، ونظرا لأن قانون المحروقات رقم 07/05 قد تجاوزه الزمن بالنظر إلى التطورات العالمية في المجال الصناعي، التقني، وحتى التشريعي، بات من الضروري مسايرة هذا التطور من خلال خلق آليات تسمح بتطوير هذا القطاع، فجاء القانون الجديد رقم 13/19 من أجل وضع النظام القانوني والإطار المؤسساتي، وكذا حقوق والتزامات الأشخاص الممارسين لنشاطات المحروقات، وهو ما أدى إلى تعميق دور وكالتي المحروقات -الوكالة الوطنية لتثمين موارد المحروقات والوكالة الوطنية لمراقبة النشاطات وضبطها في مجال المحروقات-، من خلال جعلهما سلطتين موازيتين لوزير القطاع - بالنظر إلى صعوبة هذا المجال وتشعبه- للاشتراك في تنفيذ السياسة الوطنية في مجال المحروقات. Abstract: The hydrocarbons sector represents the backbone of the Algerian economy in terms of revenues and the volume of investments, and given that the hydrocarbon law No. 05/07 has been outdated by time in view of global developments in the industrial, technical, and even legislative fields, it has become necessary to keep pace with this development by creating mechanisms that allow the development of this In the sector, the new Law No. 19/13 came in order to set the legal system and institutional framework, as well as the rights and obligations of persons practicing fuel activities, which led to the deepening of the role of the two fuel agencies - the National Agency for the Development of Hydrocarbon Resources and the National Agency for the Control and Regulation of Activities in the Field of Hydrocarbons -, By making them two authorities parallel to the Minister of the Sector - given the difficulty and complexity of this field - to participate in the implementation of the national policy in the field of hydrocarbons.
