التعامل الإلكتروني ومبدأ الشفافية في الصفقات العمومية

الملخص
تعتبر الشفافية ركيزة أساسية للسير الحسن لإجراءات إبرام الصفقات العمومية، بل إنها تعد من المبادئ الجوهرية العامة للصفقات العمومية، ذلك كونها توفر مجموعة من الضمانات لحسن استعمال المال العام، فمن جهة تسمح لكل الفاعلين بالوصول إلى كافة المعلومات حول آليات صرف المال العام في إطار الصفقات العمومية، ومن جهة أخرى، تضمن المعالجة الصحيحة والعادلة لكل عروض المتعهدين، مما يعمل على تقليص مظاهر الفساد. وتدعيما لهذا المبدأ، استحدث نظام التعامل الإلكتروني في الصفقات العمومية، الذي وفر له المشرع الجزائري الإطار القانوني الأولي منذ سنة 2010، ومازال ينقصه التفعيل على أرض الواقع، الذي يتطلب إعداد استراتيجية شاملة ومتكاملة، تستجيب للتوجيهات التقنية الدولية، وفي آجال قريبة، تسمح بتحقيق الفعالية في الصفقات العمومية. La transparence est considérée comme un pilier essentiel du bon déroulement des procédures de conclusion des marchés publics. Elle est plutôt considérée comme l'un des principes généraux de base des marchés publics, car elle fournit un ensemble de garanties pour la bonne utilisation de l'argent public. D’une part, il permet à tous les acteurs d'accéder à toutes les informations sur les mécanismes de déboursement des deniers publics dans le cadre des marchés publics, d'autre part, il assure le traitement correct et équitable de toutes les offres des entrepreneurs, réduisant ainsi les manifestations de corruption. Pour renforcer ce principe, le système de traitement électronique des marchés publics a été mis en place, dont le législateur algérien a fourni le cadre juridique initial depuis 2010, et manque toujours d'activation sur le terrain, ce qui nécessite l'élaboration d’une stratégie intégrée qui répond aux directives techniques internationales, et à court terme, qui permet d'atteindre l'efficacité dans les marchés publics. Transparency is considered an essential pillar for the smooth running of public procurement procedures. Rather, it is seen as one of the basic general principles of public procurement, as it provides a set of guarantees for the proper use of public money. On the one hand, it allows all players to access all the information on the mechanisms for disbursing public funds in the context of public contracts, on the other hand, it ensures the correct and fair treatment of all offers from entrepreneurs, thus reducing manifestations of corruption. To reinforce this principle, the electronic processing system for public contracts has been put in place, of which the Algerian legislator has provided the initial legal framework since 2010, and still lacks activation in the field, which requires the development of an integrated strategy that responds to international technical guidelines, and in the short term, that achieves efficiency in public procurement.
