دور النظام المعلوماتي في توثيق العملية التحكيمية الإلكترونية

الملخص
ملخص: بعد شيوع استخدام تقنيات المعلومات والاتصالات في إنجاز الأعمال الإلكترونية وإبرام العقود وتنفيذها عبر شبكة الإنترنت، اتجه التفكير إلى استخدام نفس هذه التقنيات الإلكترونية لتسوية ما قد ينشأ عن هذه الأعمال من منازعات، حيث ظهر التحكيم الإلكتروني، الذي تتم إجراءاته عبر شبكات الوسائل الإلكترونية، دون حاجة لتواجد أطراف هذه المنازعة في مكان واحد، وهذا الوضع الجديد يقتضي تطوير نظام قانوني ملائم وموازي يحكم هذه العملية وخاصة يوثقها ويقوم بتأمينها. من هنا كان البحث في النظام المعلوماتي في تأمين عملية التحكيم الالكتروني هدفا له، فعلى مستوى النظام القانوني الجزائري يتضح أنه لا توجد قواعد قانونية خاصة بالتحكيم الإلكتروني، على الرغم من اهتمام الدولة بالتعامل الالكتروني، إلا أننا توصلنا إلى نتيجة أن هناك أحكام قانونية كافية لتوثيق وتأمين العملية التحكيمية الإلكترونية، وقد وفق المشرع الجزائري في تنظيمها لكن هذا لا يعني عدم وضع إطار قانوني خاص بالعملية التحكيمية الإلكترونية . Abstract: After the widespread use of information and communication technologies in the completion of electronic works and the conclusion of contracts and their implementation via the Internet, thinking tended to use these same electronic technologies to settle disputes that may arise from these works, as electronic arbitration appeared, which is conducted through networks of electronic means, without the need The presence of the parties to this dispute in one place, and this new situation requires the development of an appropriate and parallel legal system that governs this process, especially documenting and securing it. From here, the search for the information system in securing the electronic arbitration process was its goal. At the level of the Algerian legal system, it becomes clear that there are no legal rules for electronic arbitration, despite the state’s interest in electronic dealings, but we have reached the conclusion that there are sufficient legal provisions to document and secure The electronic arbitration process, and the Algerian legislator has agreed to organize it, but this does not mean that there is no legal framework for the electronic arbitration process.
