حقوق الأقليات ومسألة التدخل الدولي: الأقلية الكردية في العراق أنموذجا

الملخص
الملخص: منذ القرن 19 وبشكل بارز في منطقة الشرق الأوسط، تم استخدام مسألة الأقليات كذريعة للتدخل في الشؤون الداخلية للدول، فما من مسألة من مسائل حقوق الإنسان قد استغلت لأغراض سياسية واستعمارية كمسألة الأقليات، فاعتبرت انتهاكات حقوق الإنسان واضطهاد الأقليات على يد النخب الحاكمة أو جماعة الأغلبية جريمة مخلة بأمن الإنسانية وتهديدا للسلم والأمن الدوليين، ومن ثم الانتقال من مبدأ عدم التدخل إلى الحق في التدخل اعتمادا على مبدأ " التدخل الإنساني" وإباحة هذا الحق تحت دعوى حماية الأقليات. تهدف الدراسة إلى البحث عن الأسس التي تستند عليها الدول في تطبيق مبدأ التدخل الدولي، وهل هذا التدخل جاء لحماية حقوق الإنسان والأقليات في محاولة لإنشاء قواعد عرفية دولية جديدة، أم جاء ليخدم مصالح الدول التي نادت بإنشاء نظام دولي جديد بغية تبرير استخدام القوة بشكل غير قانوني، لتحقيق أهدافها السياسية والاستراتيجية. Abstract : Since the 19th century, prominently in the Middle East, the issue of minorities has been used as a pretext to interfere in the internal affairs of States. No human rights issue has been exploited for political and colonial purposes as a minority issue, considering human rights violations and the persecution of minorities by the ruling elites of the majority group is a crime against the security of humanity and a threat to international peace and security, thus moving from the principle of non-interference to the right to intervene on the basis of the principle of "humanitarian intervention" and the legalization of this right under the pretext of protecting minorities. In this sense, the studyaims to seek the basis on which States apply the principle of International Intervention, whether this intervention came to protect human rights and minorities in an attempt to establish new international customary norms, or to serve the interests of states that advocated the establishment of a new international order to justify the illegal use of force to achieve their political and strategic goals.
