الملخص
مرّ القضاء الشرعي في الجزائر بمرحلة عصيبة خلال القرن التاسع عشر بسبب الأحداث السياسية المتمثّلة في الاحتلال الفرنسي الذي حاول التحكّم في المجالس الشرعية من خلال فرض سيطرته على التنظيم القضائي وتعيين القضاة، وقد كانت منطقة الجلفة التابعة آنذاك لإقليم المدية مسرحا للصراع بين سلطة الإدارة الفرنسية وقضاة وعلماء المنطقة. لهذا سأحاول في هذه الدراسة تسليط الضوء على تاريخ القضاء بالجلفة في القرن التاسع عشر من خلال تتبّع سير القضاة والتنظيم الإداري للقضاء والدوائر القضائية المستحدثة في المنطقة وذلك بعد قراءة فاحصة ومعقّمة للأرشيف الفرنسي المتمثّل في تقارير المكاتب العربية والكشوف الرسمية للحكومة بالجزائر، وبعد جمعٍ للوثائق المحلية من عقود عليها أختام القضاة. Abstract: The Sharia judiciary in Algeria went through a difficult stage during the nineteenth century due to the political events represented by the French occupation, which tried to control the Sharia councils by imposing its control over the judicial organization and appointment of judges. The Djelfa region, which then belonged to the Medea region, was a scene of conflict between the French administrative authority, judges and scholars of the region. Therefore, in this study, I will try to shed light on the judiciary history in Djelfa in the nineteenth century by tracing the progress of judges, the administrative organization of the judiciary, and the judicial departments created in the region, after a deep reading of the French archive, represented by the reports of Arab offices and the government official newsletter in Algeria, and after collecting local documents from Contracts bearing the seals of judges.
