الملخص
الملخص: تحرص الدول على اختيار المؤسسة أو الجهاز الذي يتكفل قانونا بإدارة كل أو بعض جوانب العمليات الانتخابية بما يضمن تنظيم مراحلها تنظيما دقيقا يفضي إلى نزاهتها ويقضي على كل ما من شأنه الإخلال بمصداقيتها. وهو الأمر الذي أدى إلى وجود أشكال ثلاث للإدارة الانتخابية تتمثل في الإدارة المستقلة، والإدارة الانتخابية الحكومية، والإدارة الانتخابية المختلطة، والجزائر بعدما جربت في هذا المجال مجموعة من النماذج صبت جلها في صالح الإدارة الحكومية انتهى بها المطاف إلى إنشاء السلطة الوطنية المستقلة للانتخابات كنموذج للإدارة الانتخابية المستقلة بموجب القانون العضوي 19/07. على هذا الأساس حاولنا تسليط الضوء على النظام القانوني للسلطة الوطنية المستقلة للانتخابات من خلال مقدمة أبرزنا فيها إشكالية الدراسة ومطلب أول تطرقنا فيه إلى صلاحيات السلطة المستقلة وأساليب عملها ومطلب ثان بينا فيه مظاهر استقلاليتها عن كل الفاعلين في العملية الانتخابية، وانتهت الدراسة بخاتمة كانت عبارة من أهم النتائج التي توصلنا إليها. الكلمات المفتاحة: الإدارة الانتخابية، السلطة المستقلة، الانتخابات، النزاهة، الحياد، الشفافية، الاستقلالية. Abstract: States are keen to choose the institution/ or organ that legally takes care of the overall management of electoral processes in order to ensure the organization of electoral stages accurately to lead to its integrity, and eliminate all that would undermine its credibility. This; in fact, led to the existence of three forms of electoral management which are: (1) independent administration, (2) governmental electoral administration, and (3) the mixed electoral administration. After Algeria had experimented a set of models, most of which were in favor of the governmental administration, the authorities had established independent national electoral authority under the organic law 19/ 07. On this basis, the present research attempted to shed light on the legal system of the independent national electoral authority through an introductory statement to highlight the research problem. Then, an illustration of the powers granted to the independent authority and its methods of work are provided in this paper. In addition, the present paper analyzed the signs of electoral authority’s independence from all actors in the electoral process. Finally, the research conludes with the major findings.
