الملخص
تتبع العملية الانتخابية العديد من الخطوات والمراحل تصبو في مجملها إلى ترسيخ السيادة الشعبية في ممارسة إرادتها بكل حرية بعيدا عن الضغوطات أو السلوكات غير المشروعة، ولعل من أهم الخطوات التي تتبعها هذه الأخيرة مرحلة ما يسمى بالحملة أو الدعاية الانتخابية التي جعلها القانون منبرا للتسابق بين المرشحين في عرض أفكارهم وسرد برامجهم على الناخبين وكسب ودهم تمهيدا للحصول على أصواتها يوم الانتخاب. إلا أنه رغم كل الضوابط التي وضعها المشرع أمام أطراف العملية الانتخابية من أجل حماية حسن سير هذه المرحلة والحد من التجاوزات التي قد تطالها، فإن ذلك لم يمنع بروز العديد من الاختلالات التي عادة ما تؤثر في شرعية ومصداقية الاستحقاقات الانتخابية برمتها، مما حذا بالمشرع الجزائري إلى تجريم كل سلوك يرمي صاحبه إلى التشويش على مصداقية الحملة الانتخابية وبمدأ المساواة وتكافؤ الفرص بين المترشحين. على هذا الأساس تناقش هذه الدراسة موضوع مهم وحساس يتعلق بسبل توفير الحماية الجزائية لضوابط الحملة الانتخابية في التشريع الجزائري من خلال تقرير عقوبات رادعة على كل العابثين بحسن سیر الدعایة الانتخابیة وبمبدأ المساواة وتكافؤ الفرص بين المترشحين. Passing through several phases, electoral entitlements aim at preserving the freedom of popular will to choose and to favor. Perhaps one of the most important stages of the latter is the so-called electoral campaign, which is allocated by the legislator to competition among candidates in presenting their ideas and programs to the electorate for endorsement and wining votes on the voting day. Despite all controls drawn by the legislature for the parties to the electoral process in order to provide effective protection for the proper functioning of this phase, this has not prevented a number of abuses that may ultimately affect the legitimacy of the entire electoral process. This; in fact, has prompted the Algerian legislature to intervene in order to criminalize any behavior that might undermine the credibility of the electoral campaign and the principle of equality and equal opportunities among candidates. The present paper attempts to analyze the issue of penal protection of electoral campaign controls in the Algerian legislation to support and promote integrity and transparency in elections by establishing deterrent penalties for all manipulators of good electoral propaganda and the principle of equality and equal opportunities among candidates
