المراكز والمؤسسات المُكلفة بتقديم الرعاية للأحداث الجانحين: دراسة في التشريع الجزائري.

الملخص
إذا كانت الأسرة تمثل المحطة الأولى والأساسية التي ينشأ فيها الطفل، تليها بعد ذلك باقي المؤسسات الاجتماعية بمختلف أشكالها وأنماطها، وصولا إلى أعلى سلطة في الدولة، فإنه من الأحرى ومن الواجب أن يعمل هؤلاء الثلاثة على إيجاد الوسيلة والأداة الفعالة التي يمكن من خلالها إقرار الحماية اللازمة للطفل الذي يمثل الحدث الجانح والمعرض للخطر المعنوي، فهو الآخر نجده ينتظر من الدولة ومؤسساتها قدرا كافيا من الحماية والرعاية والإشراف، كما أن حماية المشرع للحدث الجانح لم تأت من فراغ، وإنما جاءت لتحميه في كل مراحله العمرية، كونه عادة ما تتحكم فيه عدة عوامل خارجية خارجة عن نطاقه وإرادته وقت ارتكابه للسلوك المخالف للقانون، وهو الأمر الذي فعله المشرع من خلال إقراره للعديد من العقوبات والتدابير التي يستحقها الحدث الجانح. Abstract: If the family represents the first and basic station in which the child grows up, followed by the rest of the social institutions in their various forms and patterns, up to the highest authority in the state, then it is more appropriate that these three work to find the effective means and tool through which the necessary protection can be established For the child who represents the delinquent juvenile and exposed to moral danger, the other is waiting for the state and its institutions a sufficient amount of protection, care and supervision, and the protection of the legislator for the delinquent juvenile did not come from a vacuum, but came to protect him in all his life stages, as it is usually controlled by several external factors beyond his control and will at the time he committed the behavior in violation of the law, which is what the legislator did by approving many penalties and measures that the delinquent juvenile deserves.
