دور مبدأ التوازن بين السلطات في ضمان بناء دولة القانون.

الملخص
إن مبدأ الفصل بين السلطات كان ولا يزال من أهم المبادئ التي تُساهم في بناء دولة القانون، مع الأخذ بعين الاعتبار طريقة تطبيقه، وهامش التعاون والتوازن الذي يطبع العلاقة الموجودة بين السلطتين التنفيذية والتشريعية، وإن كانت هذه العلاقة تتفاوت حسب معطيات وظروف كل نظام سياسي، فإن ما يحمله مبدأ التوازن بين السلطات في طياته من احترام لتخصص كل سلطة في مجال معين، والتوضيح الدقيق لمعالم صلاحياتها، وكذا تكريس مبدأ الرقابة المتبادلة بين السلطتين التشريعية والتنفيذية يكون بمثابة الضامن الحقيقي لعدم استبداد أي سلطة مهما كانت بمقاليد الحكم وانفرادها باتخاذ القرار، وهو بالتالي الحامي الحقيقي لدولة القانون، إلا أن العلاقة بين السلطتين التي يطبعها التعاون والتوازن تبقى غير كافية لتحقيق الغاية المنشودة، ما لم تعزز باحترام القانون وسيادته وضمان استقلالية القضاء. Abstract: The principle of separation of powers was and still is one of the most important principles that contribute to building a state of law, taking into account the method of its application, and the margin of cooperation and balance that characterizes the relationship between the executive and legislative authorities, and if this relationship varies according to the data and circumstances of each political system, the What the principle of balance between authorities carries with it respect for the specialization of each authority in a particular field, and the precise clarification of the parameters of its powers, as well as the consecration of the principle of mutual oversight between the legislative and executive authorities is the real guarantor of the non-tyranny of any authority, whatever it is in the reins of government and its sole decision-making, and is therefore the protector The real rule of law is, however, the relationship between the two authorities, which is characterized by cooperation and balance, remains insufficient to achieve the desired goal, unless it is strengthened by respect for the law and its sovereignty and by ensuring the independence of the judiciary.
