الملخص
الملخص: يعد نظام الاتصال وتبادل المعلومات بالطريقة الإلكترونية من أهم المستجدات التي أدرجها المشرع الجزائري في المنظومة القانونية الإدارية، بهدف ضمان الخدمة العمومية وتحسين نوعيتها، بما يتناسب وتطبيق مشروع الإدارة الإلكترونية الذي مس العديد من القطاعات والمجالات، بما في ذلك مجال الصفقات العمومية بما يضمن تحسين فاعلية تدبير المال العام، وتحديث الإقتصاد الوطني. وعلى هذا الأساس صدر المرسوم الرئاسي رقم 10-236 ثم المرسوم الرئاسي رقم 15-247 ليكرسا هذا التوجه، باعتمادهما نظام التعاقد الإلكتروني كأسلوب الجديد للتعاقد الإداري في مجال إعادة التوازن مابين المتعاملين الإقتصاديين، من خلال تدعيم تعزيز مبدأ الشفافية من جهة وضمان مبدأ المساوة بين المترشحين من جهة أخرى، وكذلك من خلال تغيير النمط والأسلوب التقليدي لإبرام الصفقات العمومية نحو مفهوم جديد وأسلوب جديد للتعاقد الإداري ألا وهو التعاقد الإلكتروني. Abstract: The system of communication and exchange of information by electronic means is one of the most important developments introduced by the Algerian legislature in the administrative legal system in order to guarantee the public service and improve its quality in accordance with the application of the e-management project which touched many sectors and fields, including the field of public markets, the efficiency of public finance, and the modernization of the national economy. On this basis, Presidential Dec. 10-236 and Presidential Dec. 15-247 adopted this approach, adopting the electronic contracting system as the new method of administrative contracting in the field of rebalancing economic clients by strengthening the principle of transparency on the one hand and ensuring the principle of equality between the candidates On the other hand, as well as by changing the traditional style and method of public markets transactions, towards a new concept and a new method of administrative contracting, namely, electronic contracting.
