دور المجلس الدستوري في الرقابة على القوانين العضوية .

الملخص
تعتبر المحكمة الدستورية آلية دستورية لممارسة الرقابة السياسية على دستورية القوانين، بما فيها القوانين العضوية، وتهدف هذه الدراسة إلى بيان الدور الأساسي لهذه الهيئة في الرقابة الدستورية على القوانین العضوية باعتبارها قوانین أساسية مكملة للدستور وفي أغلبها تتصل بالحقوق والحريات مثل قانون الانتخابات والأحزاب والإعلام هذا ما یجعل خضوعها للرقابة مسألة ضرورية جدا، لذا تم اعتماد المنهج الوصفي التحليلي لوصف بعض المفاهيم وتحليل العديد من النصوص القانونية التي تضمنتها الدراسة، وتوصلنا كنتيجة إلى محدودية هذه الرقابة، حيث حصر الإجراء في جهة واحدة هي رئيس الجمهورية، وقد يكون الأمر غير كاف مما يستوجب مع توسيع سلطة الإخطار. AbstractThe Constitutional Court is a constitutional mechanism for exercising political control over the constitutionality of laws, including organic laws. This study aims at indicating the main role of this system in constitutional supervision over the organic laws as essential laws that complement the constitution, and most of them are related to rights and freedoms such as the elections, parties and media law, which makes its subject to censorship a very necessary matter. Therefore, the analytical descriptive approach was adopted to describe some of the concepts and to analyze many of the legal texts included in this study. As a result of this limited control that the procedure is restricted to one side, the President of the Republic, and may not be sufficient, thus requiring the extension of the power of notification.
