السرقة العلمية في ظل البيئة الرقمية

الملخص
تسعى ورقتنا البحثية هذه لإثارة أحد المواضيع الهامة المتعلقة بمجال البحث العلمي الذي إرتبط مؤخرا بالفضاء الإلكتروني، وأجبر الباحث على ضرورة التأقلم مع هذا التغير و مواكبة عصر الرقمنة خلال مساره العلمي، ورغم الإيجابيات التي وفرها هذا التزاوج بين العلم والتكنولوجيا وإنعكاسه إيجابا على الباحث نظرا لما يوفره له من مصادر ومعلومات كثيرة و في أشكال وقوالب مختلفة، فإنه من جانب آخر له إنعكاسات سلبية عديدة تتحدد وفق إستعمال الباحث لها، أكثرها وقوع الباحث في فخ السرقة العلمية، وجاءت العديد من النصوص والقوانين التي تضبط هذه التجاوزات الأخلاقية للباحثين رغم قصور بعضها، بحيث لم تركز على هذا الجرم الأخلاقي في البيئة الرقمية وعلى سبيل المثال ما تطرقنا له في دراستنا النظرية هذه، وهو ما جاء في منشور وزارة التعليم العالي والبحث العلمي في الجزائر عبر القرار رقم1082المؤرخ27ديسمبر 2020 الذي حدد القواعد المتعلقة بالوقاية من السرقة العلمية ومكافحتها من أجل حماية الملكية الفكرية و حقوق المؤلف، لردع الباحثين عن الوقوع في فخ السرقة، مع غياب نصوص حول هذا الجانب المهم في البيئة الرقمية. Abstract Our research paper seeks to raise one of the important topics related to the field of scientific research, which has recently been associated with cyberspace, and forced the researcher to adapt to this change and keep pace with the era of digitization during his scientific path, and despite the positives provided by this marriage between science and technology and its positive reflection on the researcher due to the many sources and information it provides him in different forms and templates, on the other hand, it has many negative repercussions that are determined according to the researcher's use of them, most of which is the researcher's occurrence in The trap of scientific theft, and many texts and laws that control these ethical transgressions of researchers, despite the shortcomings of some of them, did not focus on this ethical crime in the digital environment, for example, what we touched on in this theoretical study, which was stated in the publication of the Ministry of Higher Education and Scientific Research in Algeria through Resolution No. 1082 of December 27, 2020, which specified the rules related to the prevention and combating of scientific theft in order to protect intellectual property and copyright, to deter researchers from falling into The trap of theft, with the absence of texts on this important aspect of the digital environment.
