الملخص
الملخص مع تطور قطاع النقل أصبح اعتماد المستهلكين على النقل الجوي أمرا مهما خاصة لما له من مميزات تيسر لهم تلبية الحاجيات اليومية أو الكمالية بالرغم من إمكانية حدوث بعض المخاطر التي قد تلحق بالناحية الجسدية أو المالية لمستهلك هذه الخدمة ، هذا الأخير الذي يمكن أن يكون من فئة ذوي الاحتياجات الخاصة ، فيعمد إلى إبرام عقد للسفر منفردا أو بمرافق في علاقة تعاقدية مع الناقل الجوي تبدأ لحظة حجز التذكرة. ولقد اعتبره المشرع طرفا ضعيفا في عقد النقل الجوي بسبب خصوصية إعاقته، حيث شدد في مجموع الالتزامات التي فرضها في جانب الناقل الجوي حماية له و ضمانا لمصلحته، وهذا من خلال الآليات القانونية المكرسة في التعديلات الأخيرة لقانون الطيران المدني. Abstract: With the development of the transport sector, consumers dependence on air transport has become particularly important because of its advantages in meeting daily or luxury needs, despite the possibility of some risks to the physical or financial aspect of the user of this service, the latter, who may be of the category of special needs, enters into a contract of travel alone or with facilities in a contractual relationship with the air carrier which begins at the moment of booking the ticket. The legislator considered him a weak party to the air transport contract because of his disability, as he stressed the total obligations he imposed on the side of the air carrier to protect him or her interest, and this is through the legal mechanisms enshrined in the recent amendments to the Civil Aviation Law. Résumé Avec le développement du secteur des transports, La dépendance des consommateurs à l’égard du transport aérien est devenue particulièrement importante parce qu’elle a l’avantage de leur permettre de répondre aux besoins quotidiens ou de luxe malgré la possibilité de certains risques qui peuvent atteindre l’aspect physique ou financier du consommateur de ce service qui peut être parmi les personnes a besoins spéciaux qui conclu un contrat de voyage individuellement ou avec des installations dans une relation contractuelle avec le transporteur aérien à partir du moment de la réservation du billet. Le législateur le considérait comme une partie faible au contrat de transport aérien en raison de son handicap particulier, comme il l’a souligné dans l’ensemble des obligations qu’il avait imposées au transporteur aérien pour le protéger et assurer ses intérêts, par les mécanismes juridiques enchâssés dans les récentes modifications à la Loi sur l’aviation civile.
