التّطبيقات القانونية للتّذكرة الإلكترونية في النّقل الجوّي للأشخاص. Legal Applications Of Electronic Ticket In Passenger’s Air Transport.

الملخص

في محاولة من المجتمع الدّولي عصرنة قطاع الطّيران المدني الذي يعتبر حلقة وصل اقتصادي فعّال، وتوسيع نطاق خدماته بغية تسهيل التّعاملات التّجارية لكسب أكبر عدد من المستهلكين وتحقيق ربح معتبر، تمّ استحداث التّذاكر الإلكترونية التي تمثّل وسيلة إثبات عقد نقل بين النّاقل والمسافر وضمانا على تنفيذ هذا النقل، ما يرتب على كلا الطّرفين تحمّل التزامات والتمتّع بحقوق. ولمّا كان المسافر الطرف الأضعف في هذه العلاقة التّعاقدية شدّدت الإتفاقيات من مسؤوليات النّاقل، بفرضها بعض الإلتزامات على الناقل التي تحمي المسافر وتمثّل تجسيدا للسلامة الجوية في آن واحد ، وهو ما سايره المشرع الجزائري من خلال إصداره للمرسوم التنفيذي رقم 16-175 المحددّ لشروط وكيفيات تطبيق حقوق ركّاب النقل الحجوّي العمومي، الذي حمى به الرّاكب الجوّي وتمّم به القانون الجوّي الوطني رقم 98-06. In an attempt by the international community to modernize the civil aviation sector, which is considered an effective economic link, and to expand its services in order to facilitate commercial transactions to gain the largest number of consumers and achieve a significant profit, electronic tickets have been introduced that represent a means of establishing a transport contract between the carrier and the passenger and to ensure the implementation of this transport. Whereas the traveler was the weakest party in this contractual relationship, the agreements tightened the responsibilities of the carrier, by imposing some obligations on the carrier that protect the passenger and represent an embodiment of air safety at the same time, which is what the Algerian legislator has followed through his issuance of Executive Decree No. 16-175 specifying the terms and conditions for the application of rights Public air transport passengers, with which the air passenger protected and fulfilled by National Air Law No. 98-06.
