أثر الثبات التشريعي على تسيير العقار الموجه لإنجاز مشاريع استثمارية

الملخص
يعد مبدأ الثبات التشريعي من مقومات الأمن القانوني كإحدى الضمانات الجاذبة للاستثمار، لذا تم تكريسه صراحة بموجب التعديل الدستوري لسنة 2020، وكذا النصوص المتعلقة بالاستثمار، آخرها قانون الاستثمار لسنة 2022. إن كثرة النصوص القانونية ذات الصلة بالاستثمار في العقار الصناعي، وتناثرها وكثرة التعديلات الواردة عليها إما بموجب قوانين المالية أو قوانين المالية التكميلية اثرت على فعلية وفعالية هذا المبدأ، غير أن ذلك كان بهدف دفع وتيرة الاستثمار وحماية حقوق المستثمرين خاصة بإقرار مبدا رجعية القوانين كضمانة من جهة، وحماية العقار محل الاستثمار من جهة أخرى. The principle of legislative stability is one of the foundations of legal security as one of the attractive guarantees of investment. It is therefore explicitly enshrined in the constitutional amendment of 2020, as well as the provisions on investment, the latest of which is the Investment Act of 2022.The proliferation of legal texts relating to investment in industrial real estate, their scattering and the many amendments to them either under finance laws or supplementary financial laws have affected the effectiveness and effectiveness of this principle, but this has been aimed at accelerating investment and protecting investors' rights, especially by establishing the retrospective of laws as collateral on the one hand, and protecting the property in question on the other.
