حماية المنافسة في الصفقات العمومية من تجاوزات الموظف العمومي (وفقا لأحكام قانون الوقاية من الفساد ومكافحته)

الملخص
ملخص: تتمحور هذه الدراسة حول الآليات التي نص عليها المشرع الجزائري في القانون 06-01 من أجل الحد من التجاوزات الخطيرة التي يقوم بها الموظف العمومي في الصفقات العمومية، والتي تعتبر من الأسباب الرئيسية في التقليص من المنافسة، حيث أعطى هذا القانون مفهوما واسعا للموظف العمومي مقارنة بالقانون الأساسي للوظيف العمومي بغرض توسيع مجال المسؤولية لكل شخص قام بإبرام أو المشاركة في عملية إبرام الصفقة العمومية، كما أنه قام بتجريم هذه الأفعال التي تؤثر سلبا على الصفقة العمومية، و تسليط عقوبات ردعية قصد مجابهة هذه الجرائم، بالمقابل قام المشرع بإتخاذ مجموعة من التدابير الوقائية التي تساهم في الحد من هذه الظاهرة و تساهم في وضع الموظف العمومي في أحسن الظروف و حمايته من الوقوع في هذه الجرائم. Abstract: This study revolves around the mechanisms stipulated by the Algerian legislator in Law 06-01 in order to limit the serious abuses committed by the public official in public deals, which are considered one of the main reasons for reducing competition, as this law gave a broad concept to the public official compared to the law The basic role of the public office in order to expand the area of responsibility for each person who concludes or participates in the process of concluding the public deal, and he criminalized these acts that negatively affected the public deal, and imposed deterrent penalties in order to confront these crimes. In return, the legislator took a set of preventive measures that It contributes to reducing this phenomenon and contributes to placing the public servant in the best conditions and protecting him from falling into these crimes.
